- Účelem tohoto eseje je nastolení filosofického základu do myšlenek týkajících se finanční satisfakce v případě zásahu do osobnostních práv, a to zejména s ohledem na ty ze zásahů, které mají podobu zásahů do fyzické integrity člověka. Článek si před sebe klade několik otázek, na které chce nalézt odpovědi, případně pouze načrtnout možné úvahy, kterými by se měl soudci, ale i zákonodárci při interpretaci a tvorbě právních norem regulujících ochranu osobnosti a případnou finanční satisfakci zabývat. Autoři se zabývají jednak historickou rovinou a komparací jednotlivých úprav v českém právním řádu a dále komparací se zahraničními úpravami, samozřejmě s ohledem na recentní právní literaturu i judikaturní závěry. Stále aktuální z tohoto hlediska se jeví i otázka promlčitelnosti peněžitých nároků plynoucích z osobnostních práv. K této otázce byla již vyřčena řada názorů, nicméně do jisté míry většinou vycházejí pouze z praktických hledisek, nikoliv z širšího filosoficky-právního odůvodněného názoru. Práce poukazuje na současný trend v judikatuře, ale zároveň se snaží poukázat i na teleologické aspekty, které je nutné při chápání institutu promlčení v oblasti uplatnění nároků finanční satisfakce vzít v úvahu. Poslední problémem, který se v širokých aspektech dotýká i nové úpravy, je otázka srovnání uplatnění nároků podle § 444 a § 13 odst. 2, resp. otázka po srovnání otázka škody na zdraví a imateriální újmy. Závěrem by pak měly být zejména zdůrazněny jednotlivé systematické nedostatky a úvahy, jakým směrem by se de lege ferenda měla česká legislativa v této oblasti pohybovat., The purpose of this essay is to introduce a philosophical foundation into the ideas relating to financial satisfaction in the case of interference with personal rights, especially with respect to those of the interferences, which have a form of interferences with a physical integrity of a man. The article raises several questions, to which it wants to find answers, or merely outline potential considerations, which should be dealt with by both judges, as well as legislators during interpretation and development of legal rules regulating protection of personal rights and prospective financial satisfaction. The authors are partly concerned with a historical perspective, partly with the comparison of individual regulations in the Czech legal order and furthermore with the comparison of foreign regulations, of course, with respect to recent legal literature and judicial decisions. From this point of view the issue of a statutory bar on pecuniary claims resulting from personal rights is still up to date. A whole number of opinions was expressed as to this issue, however to a certain extent they mostly come only from practical standpoints, not from the broad philosophically and legally justified opinion. The work indicates contemporary trends in judicature, but at the same time it tries to point out also theological aspects, which must be considered, when understanding the statutory bar in the area of assertion of claims to financial satisfaction. The last issue, which also touches the last regulation in broader aspects, is the question of comparison of assertion of claims pursuant to Section 444 and Section 13 (2), or the question of damage to health and immaterial damage. - Cíl: Cílem studie bylo zjistit, jak rodinní pečovatelé pečující o blízkou osobu v České republice hodnotí definující charakteristiky ošetřovatelské diagnózy Přetížení pečovatele. Metodika: Na klinickou validizaci ošetřovatelské diagnózy Přetížení pečovatele byl použit „Na pacienta zaměřený Fehringův model klinické diagnostické validity“. Výzkum u rodinných pečovatelů probíhal v měsících srpen a září 2010 v Agentuře domácí péče Victoria na území města Šumperk. Do výzkumného souboru bylo vybráno 50 rodinných pečovatelů, kteří pečovali o své blízké v domácím prostředí déle než 2 roky. Souhlas se zařazením do výzkumu vyjádřilo 23 rodinných pečovatelů, co je 46 %. Výsledky: Rodinní příslušníci za hlavní definující charakteristiky Přetížení pečovatele označili celkem 8 charakteristik: obavy z možné institucionalizace péče příjemce; obavy, jak vyřešit péči o člena rodiny, když nebudu schopen tuto péči vykonávat; obavy o zdraví příjemce péče v budoucnosti; obavy související se schopností pečovatele poskytovat péči v budoucnosti; konflikt v rodině; nejistota ze změny vztahu s příjemcem péče; smutek ze změny vztahu s příjemcem péče; starost o členy rodiny. Za vedlejší bylo označeno 10 definujících charakteristik: obtíže v dokončování požadovaných úkolů, obtíže se sledováním příjemce péče v průběhu nemoci, obtíže ve vykonávání požadovaných úkolů, vysoký krevní tlak, kardiovaskulární onemocnění, somatizace, frustrace, depresivní nálada, porušený spánek, stres. Závěr: Pro skupinu vybraných pečovatelů nebyly všechny definující charakteristiky uvedeny v klasifikačním systému NANDA International významné., Aim: The aim of the study was to find out how the family caregivers caring for their close relatives in the Czech Republic evaluate defining characteristics of the nursing diagnosis Caregiver Role Strain. Methods: Fehring´s patient – focused clinical diagnostic validity model was used to clinical validation of the nursing diagnosis Caregiver Role Strain. The research was ongoing during the months August and September 2010 at Home Care Agency Victoria in region of city Šumperk. Fifty family caregivers, who take care for their family members more than 2 years, were chosen to the research sample. Twenty three caregivers (46 %) agreed with their including to the research. Results: Caregivers classified in total the following eight defining characteristics as major ones: apprehension about possible institutionalization of care receiver, apprehension about care receiver´s care if caregiver unable to provide care, apprehension about the future regarding care receiver´s health, apprehension about the future regarding caregiver´s ability to provide care, family conflict, uncertainty regarding changes relationship with care receiver, grief regarding changed relationship with care receiver, concerns about family members. Caregivers classified ten defining characteristics as minor ones: difficulty completing required tasks, difficulty watching care receiver go through the illness, difficulty performing required tasks, hypertension, cardiovascular disease, somatization, frustration, feeling depressed, disturbed sleep, stress. - Health Technology Assessment (HTA) denotes a process (resp. a study), the objective of which is to get an idea about clinical, economic and ethical aspects of a health technology, including its effect to the quality of life, and a consequent assessment. The output of this process is compiled under strict methodological conditions, and it has only a character of recommendation. Abroad, HTA is intensely used above all to complex comparing two (or several) technologies. When the origin of HTA goes back to 1960 ́s and 1970 ́s, the first information appeared in the Czech Republic in the beginning of this millennium. No Czech institution is a member of international organizations INEHTA and HTAi, which makes any access to foreign know- how more difficult. Although no complex study has been probably produced in the Czech Republic, some efforts to a larger utilization of HTA methods can be seen, above all in pharmacoeconomics. - Za tři desetiletí se technika in vitro oplození proměnila z oboru, v který věřil jen málokdo, na techniku, která je pevnou součástí moderní medicíny. Obavy, které s ní byly spojovány, se nenaplnily. Naopak, in vitro oplození našlo uplatnění i tam, kde to nikdo nepředpokládal. V kombinaci s předimplantační genetickou diagnostikou se využívá jako prevence dědičných onemocnění. Potřeba oplození in vitro se ukázala i v zemích třetího světa, které se potýkají s důsledky populační exploze. V současnosti se rozvíjejí nové biotechnologie, které narážejí na odpor veřejnosti. Historie se opakuje. Jsou zdůrazňovány především jejich možná i ryze hypotetická rizika a mnohé jejich budoucí přínosy nejsou a za současného stavu poznání ani nemohou být předvídány. Rozvoj in vitro oplození nabízí lekci pro hodnocení nastupujících biotechnologií. Jejich výrazné omezení nebo dokonce zákaz by zjevně znamenaly pro budoucnost lidstva závažná omezení., During the past three decades, human in vitro fertilization (IVF) has changed from disdained technique to one which constitutes a respected branch of modern medicine. Concerns connected with human in vitro fertilization have not materialized. On the other hand, in vitro fertilization has demonstrated benefits in unexpected areas. When combined with techniques of molecular genetics such as preimplantation genetic diagnostics, it can prevent the occurrence of hereditary diseases. In vitro fertilization is greatly needed even in developing countries, despite the fact that the Third World is heavily confronted with the impacts of population explosion. At present, many new and promising biotechnologies are fighting strong opposition from the public. The history of human IVF recurs. Even hypothetical risks are emphasized, and many future benefits are not recognized or cannot be recognized at the present state of knowledge. The significant progress of human IVF provides us with a lesson for the evaluation of impending biotechnologies. - To study efficiency of the combined treatment of advanced gastric cancer with inclusion Trastuzumab. Material: We present the intermediate analysis of the use of target therapy with Trastuzumab in patients with a HER2positive gastric cancer. Up to 01.10.2009y 118 patients have been tested for HER2 expression, and in 24 gastric cancer patients it is revealed HER2positive status of tumor. It is lead chemotherapy to all patients by the PLF regimen and Herceptin in doze 6 mg/kg once in 3 weeks (6 cycles). In control group in 26 patients it is lead only chemotherapy by the PLF regimen once in 3 weeks without addition Trastuzumab (6 cycles). Results: At the moment of the analysis of preliminary data, the median remission duration in compared groups has made 8.3 months, and 5.2 months, accordingly.
