Tento článek se zabývá teoretickou koncepcí trestněprávního poměru a trestněprocesního vztahu s přihlédnutím k postavení oběti ve světle rozhodovací praxe Ústavního soudu České republiky a Evropského
soudu pro lidská práva. K tématu článek přistupuje se zřetelem na význam teorie společenské smlouvy pro oblast trestního práva a následně předkládá analýzu judikatury výše zmíněných soudů. Závěr ukazuje, že nejen stanoviska, která vytvořila tyto dva přístupy, nemusí nutně být v naprosté vzájemné shodě, ale že i praxe Ústavního soudu České republiky a Evropského soudu pro lidská práva vykazují rozdíly. Po tomto dílčím závěru se článek zaměřuje na samotnou možnost oběti být subjektem trestněprávního poměru s přihlédnutím k přístupu zahraničních právních řádů k této problematice, a vytváří několik úvah založených na povaze postavení oběti a jejího vzájemného vztahu ke státu, jakož i k vzájemnému
vztahu státu a pachatele se závěrem, že trestněprávní poměr může i nadále přetrvávat ve své dvoustranné podobě, ačkoliv se k němu přidává ještě další – mezi obětí a státem. and This article focuses on the theoretical conception of substantive and procedural relations of the criminal law with particular focus on the status of the victim in the light of the decisional practice of the Constitutional Court of the Czech Republic and of the European Court of Human Rights. It approaches the topic through the lense of the social contract theory in the field of criminal law and later it presents an analysis of the jurisprudence of the aforementioned courts. The conclusion shows, that not only these standpoints that these two approaches have created, might not be altogether in perfect congruence, but that the practice of the Czech Constitutional Court and that of European Court of Human Rights differs. Following this partial conclusion, this article focuses on the very possibility of the victim to be a subject of the substantive relation in the criminal law with regards to the approach of foreign jurisdictions and introduces a few ideas based on the nature of the victim’s status and its mutual relation to the state, as well as to that of the perpetrator and the state with the conclusion that the substantive
relation in the criminal law can persist in its two-sided form, although there is now another one – between the victim and the state.
