Dne 1. 1. 2014 nabyde účinnosti nový občanský zákoník (dále jen „NOZ“). Změny, které s sebou přinese, jsou pro oblast soukromého práva dalekosáhlé a v mnoha ohledech se dotknou rovněž poskytování zdravotní péče, resp. poskytování zdravotních služeb ve smyslu zákona č. 372/2011 Sb. o zdravotních službách (dále jen „ZZS“). Současně je nutno podotknout, že NOZ svou koncepcí a vztahem k ZZS bude působit řadu interpretačních a aplikačních problémů., The aim of this article is to summarize main impacts of new civil code on medical law and describe the most important changes. It is obvious that new civil code provides very far reaching changes for the treatment providers and their patients. This code presents completely new type of contract – treatment contract. It means that accordingly new civil code between a patient and treatment provider exists a contractual relationship and therefore the liability for medical malpractice is based on breach of contract. Besides these conceptual changes contains new civil code small changes which directly affect providing of medical services - for example presumption of consent with medical treatment or new catalogue of rights of persons involuntary detained in hospitals., Tomáš Doležal, and Literatura
It is obvious that n ew civil code provides very far reaching changes for the healthcare providers and their patients. Civil code presents completely new type of contract – treatment contract. This regulation w as influenced especially by DCFR and Dutch civil code. But due to historical reasons it is not completely clear if this new type of the contract is applicable without exceptions in all relationship s between healthcare provider s and patient s or there are al so other types of contracts which are ap p licable. The aim of this article is to provide guidelines for this determination of different types of contractual relationship .
