Účelem tohoto eseje je nastolení filosofického základu do myšlenek týkajících se finanční satisfakce v případě zásahu do osobnostních práv, a to zejména s ohledem na ty ze zásahů, které mají podobu zásahů do fyzické integrity člověka. Článek si před sebe klade několik otázek, na které chce nalézt odpovědi, případně pouze načrtnout možné úvahy, kterými by se měl soudci, ale i zákonodárci při interpretaci a tvorbě právních norem regulujících ochranu osobnosti a případnou finanční satisfakci zabývat. Autoři se zabývají jednak historickou rovinou a komparací jednotlivých úprav v českém právním řádu a dále komparací se zahraničními úpravami, samozřejmě s ohledem na recentní právní literaturu i judikaturní závěry. Stále aktuální z tohoto hlediska se jeví i otázka promlčitelnosti peněžitých nároků plynoucích z osobnostních práv. K této otázce byla již vyřčena řada názorů, nicméně do jisté míry většinou vycházejí pouze z praktických hledisek, nikoliv z širšího filosoficky-právního odůvodněného názoru. Práce poukazuje na současný trend v judikatuře, ale zároveň se snaží poukázat i na teleologické aspekty, které je nutné při chápání institutu promlčení v oblasti uplatnění nároků finanční satisfakce vzít v úvahu. Poslední problémem, který se v širokých aspektech dotýká i nové úpravy, je otázka srovnání uplatnění nároků podle § 444 a § 13 odst. 2, resp. otázka po srovnání otázka škody na zdraví a imateriální újmy. Závěrem by pak měly být zejména zdůrazněny jednotlivé systematické nedostatky a úvahy, jakým směrem by se de lege ferenda měla česká legislativa v této oblasti pohybovat., The purpose of this essay is to introduce a philosophical foundation into the ideas relating to financial satisfaction in the case of interference with personal rights, especially with respect to those of the interferences, which have a form of interferences with a physical integrity of a man. The article raises several questions, to which it wants to find answers, or merely outline potential considerations, which should be dealt with by both judges, as well as legislators during interpretation and development of legal rules regulating protection of personal rights and prospective financial satisfaction. The authors are partly concerned with a historical perspective, partly with the comparison of individual regulations in the Czech legal order and furthermore with the comparison of foreign regulations, of course, with respect to recent legal literature and judicial decisions. From this point of view the issue of a statutory bar on pecuniary claims resulting from personal rights is still up to date. A whole number of opinions was expressed as to this issue, however to a certain extent they mostly come only from practical standpoints, not from the broad philosophically and legally justified opinion. The work indicates contemporary trends in judicature, but at the same time it tries to point out also theological aspects, which must be considered, when understanding the statutory bar in the area of assertion of claims to financial satisfaction. The last issue, which also touches the last regulation in broader aspects, is the question of comparison of assertion of claims pursuant to Section 444 and Section 13 (2), or the question of damage to health and immaterial damage. V loňském roce vyšel v Časopise zdravotnického práva a bioetiky článek Skalpel a duše (č. 1/2013, autorka Andrea Baršová), který se zabýval proměnami vztahu společnosti a práva k transsexualitě. O několik měsíců později přinesla světová média zprávu o „uznání třetího pohlaví“ v Německu. Novinka s obsahem citovaného článku souvisí. Stejná linie myšlení, která vedla k upuštění od nucených zásahů do těla u transsexuálů, má zde svoji paralelu v přístupu k intersexuálním lidem. Předkládaný příspěvek shrnuje dosavadní přístupy k intersexualitě a seznamuje s nejnovějším vývojem v Německu, zemi s výrazným hnutím intersexuálních lidí, a na mezinárodní úrovni. Malá změna v německém právním řádu, a sice možnost neuvést v matriční knize narození pohlaví dítěte, má zatím k uznání jiného pohlaví daleko. Zpráva Německé etické rady z roku 2012, která německé zákonodárce ke změně vedla, a probuzený zájem mezinárodních lidskoprávních organizací o toto téma jsou však zřetelnými signály nastupující paradigmatické změny v přístupu k intersexuálním lidem v naší kultuře., A year ago, the article by Andrea Baršová Skalpel a duše (Scalpel and the Soul), which addressed recent transformation of societal and legal attitudes towards transsexuals, was published by the Journal of Medical Law and Bioethics (1/2013). A few months later, media worldwide released news on the recognition of third sex in Germany. This development is linked to the published article. The same line of thinking, which led to abandonment of enforced medical interferences in the bodies of transsexuals (in order to recognise their gender change), has here its parallel in current attitudes towards intersex people. This article sums up existing approaches to intersex individuals and discusses newest developments in Germany, a country with strong intersex movement, and on the international level. A small change in the German law, namely an option to leave open the entry for sex in birth registers, is far from legal recognition of other sex as such. Rozvoj paliatívnej starostlivosti v bývalom Československu je možné v modernej podobe sledovať až po roku 1989. Prvý hospic na území Českej republiky bol založený v roku 1995, na Slovensku až v roku 2002. Toto oneskorenie vývoja, spôsobené historickými udalosťami, sa odráža aj v legislatíve upravujúcej danú problematiku. Medzinárodnoprávna úprava a ústavnoprávna úprava sú v obidvoch krajinách v zásade rovnaké. Ako Česká, tak aj Slovenská republika sa hlásia k ochrane ľudských práv a slobôd i k ochrane zdravia. K ochrane zdravia patrí okrem mnohých iných aspektov aj poskytovanie paliatívnej starostlivosti, pričom táto starostlivosť je mnohokrát vnímaná ako okrajová. Dopyt po nej však vzhľadom k demografii obidvoch štátov zrejme bude stúpať a preto je namieste zaoberať sa právnym stavom tejto reality. Paliatívna starostlivosť zasahuje do zdravotnej a sociálnej sféry spoločnosti, pričom ale spolupráca medzi týmito sektormi nie je ani zďaleka ideálna. Súčasná medzinárodnoprávna úprava je neefektívna, čo je spôsobené jej špecifickým charakterom, vnútroštátna úprava je roztrieštená, neprehľadná a neúplná, čo poskytuje priestor pre vznik problémov v každodennej praxi. Orientácia v predmetnej právnej úprave nie je jednoduchá ani pre odborníka. Vzhľadom na fakt, že väčšina zdravotníckych pracovníkov pôsobiacich v oblasti poskytovania paliatívnej starostlivosti, sú laici, je pre nich táto úloha takmer nemožná. Cieľom tohto článku je poskytnúť prehľad predmetnej právnej úpravy s niekoľkými poznámkami ohľadom právnej úpravy sledovanej problematiky v Nemecku a v Rakúsku., The development of palliative care in former Czechoslovakia can be noticed only after the year 1989. The first hospice in the territory of the Czech Republic was founded in 1995, in the Slovak Republic in 2002. This delay of development, caused by historical events, is also reflected in the legislation regulating the given area. Regulation on international and constitutional level in both countries is essentially the same. Both Czech and Slovak Republic declare their support of the protection of human rights and freedoms, as well as protection of health. However provision of palliative care, although a part of health protection, is in reality often perceived as marginal and therefore neglected. Demand for palliative care, especially due to the demographic perspectives of the two countries, will most probably rise, and therefore addressing the legal aspects of this fact is most definitely in place. Palliative care in general closely connects both health and social care sectors of a society, but the actual cooperation between these sectors in the Czech Republic and the Slovak Republic is far from ideal. The current international regulation is ineffective, which is caused mainly by its specific nature, while the national regulation is fragmented, confusing and incomplete. This fact allows for the emergence of problems in everyday practice. The orientation in the related regulation is not easy even for a legal professional. Considering the fact that the majority of health professionals working in the area of providing palliative care are laymen, their orientation therein is virtually impossible. Příspěvek poukazuje na skutečnost, že nezakotvení náhradního mateřství v současné právní úpravě, zejména soukromého práva, přináší zásadní problémy nejen v oblasti práva, ale i v životě fyzických osob. Dne 1. 1. 2014 nabyde účinnosti nový občanský zákoník (dále jen „NOZ“). Změny, které s sebou přinese, jsou pro oblast soukromého práva dalekosáhlé a v mnoha ohledech se dotknou rovněž poskytování zdravotní péče, resp. poskytování zdravotních služeb ve smyslu zákona č. 372/2011 Sb. o zdravotních službách (dále jen „ZZS“). Současně je nutno podotknout, že NOZ svou koncepcí a vztahem k ZZS bude působit řadu interpretačních a aplikačních problémů., The aim of this article is to summarize main impacts of new civil code on medical law and describe the most important changes. It is obvious that new civil code provides very far reaching changes for the treatment providers and their patients. This code presents completely new type of contract – treatment contract. It means that accordingly new civil code between a patient and treatment provider exists a contractual relationship and therefore the liability for medical malpractice is based on breach of contract. Povinnost mlčenlivosti je jedna ze základních profesních povinností spojených s prací zdravotnických pracovníků. Je to zcela konkrétní institut na ochranu soukromí pacientů, nutný zejména proto, že při poskytování zdravotní péče více než v jiných oblastech lidské činnosti dochází k primárnímu (údaje zjištěné při diagnostice či léčbě) i sekundárnímu (údaje získané od pacienta či jeho blízkých) získávání informací o velmi intimních stránkách lidského života. Nicméně existuje řada právně relevantních důvodů, které zakládají možnost oprávněně porušit tuto povinnost a informace získané při poskytování zdravotní péče sdělit. Oprávněné důvody jsou vždy založeny na poměřování hodnot, které stojí za povinností mlčenlivosti, a hodnot, které stojí za potřebou či nutností tuto povinnost porušit. Specifickou oblastí střetu těchto hodnot je sdělování údajů chráněných povinností mlčenlivosti orgánům činným v trestním řízení. Vedle hlavního důvodu, který umožňuje zdravotnickému pracovníkovi poskytnout vyžádanou informaci policisty, státními zástupci či trestními soudci, kterým je souhlas samotného pacienta, o jehož údaje se jedná, zná český právní řád množství jiných důvodů, byť často velmi úzce zaměřených, které vyplývají z různých právních předpisů. Tento text se nezaměřuje pouze na uvedení důvodů, kdy zdravotnický pracovník je oprávněn podle práva chráněné informace sdělit, ale také upozorňuje na situace, kdy tak naopak učinit nesmí, přestože to po něm některý z orgánů činných v trestním řízení vyžaduje. Tyto pasáže byly formulovány na základě vlastních zkušeností a poznatků autora ze styku zdravotnických zařízení či zdravotnických pracovníků s orgány činnými v trestním řízení. Závěrem je pak poukázáno na sankce, které hrozí zdravotnickému pracovníkovi, pokud podlehne tlaku ze strany orgánů činných v trestním řízení a požadované informace neoprávněně sdělí., An obligation to maintain secrecy is one of the basic professional duties associated with the work of health workers. It's very specific institute of patient privacy, especially necessary because during the provision of health care more than in other areas of human activity information of very intimate sites of human life are gathered by a primary (data collected from the diagnosis and treatment activity) and secondary (data obtained from the patient or his relatives) ways. However, there are many legally relevant reasons that give rise to legally break this obligation and to tell information obtained in providing health care. Justified reasons are always based on measuring the values behind the duty of confidentiality, and the values behind the need or necessity to break this obligation. A specific area of this conflict of values is disclosure of protected data to criminal law enforcement authorities. Besides the main reason that allows the health professional to provide requested information to the police, prosecutors and criminal judges, which is the consent of the patient the Czech law knows a number of other reasons, though often very narrowly focused, arising from different legal regulations. This text does not focus solely on the grounds where the healthcare worker is entitled to communicate information protected by the law, but also points to situations where do not, though one of the institutions of law enforcement requires it. These passages have been formulated based on the author's experience and knowledge by the interaction of medical institutions or medical personnel with criminal law enforcement authorities. V souvislosti s ochranou lidských práv zaručených Úmluvou o ochraně lidských práv a základních svobod se v poslední době čím dál častěji diskutuje otázka, zda přístup k asistované reprodukci také spadá pod rámec ochrany poskytovaný Úmluvou. Příspěvek přináší přehled rozhodnutí Evropského soudu pro lidská práva, která se problematikou asistované reprodukce zabývaly. Na pozadí těchto rozhodnutí se příspěvek snaží analyzovat hranice rozšiřujícího pojetí práva na respektování rodinného a soukromého života podle čl. 8 Úmluvy a poukázat na skutečnost, že v oblasti řešení složitých biomedicínckých a bioetických otázek nemá Soud dostatečnou autoritu na to, aby se stal finálním arbitrem při posuzování hodnotových měřítek společnosti v jednotlivých evropských státech., In the last few decades decided European Court of Human Rights very problematic cases involving “right to access to assisted reproduction”. These cases are concerning very controversial ethical aspects of biomedical developments in the field of medical techniques of artificial procreation and reshape the content (meaning) of Article 8 of European Convention of Human Rights. This paper provides short overview of cases of European Court of Human Rights involving “right to access to assisted reproduction” and focuses especially on the latest developments in this field (case S.H. and Others v. Austria - Application no 57813/00) . Although the technology of medically assisted procreation had been available in Europe for several decades, many of the issues to which it gave rise, remained the subject of debate. There is no consensus towards the use of IVF treatment in general and even less clear are trends in some particular questions (f.e. allowing gamete donation). Výluka sexuálně aktivních gayů (mužů majících pohlavní styky s muži) z darování krve v mnoha zemích je sporná. Před soudy a v parlamentech ji napadají ochránci lidských práv. Spor se v případě Léger dostal až před Soudní dvůr Evropské unie. Soudní dvůr se nicméně vyvaroval lidskoprávního aktivismu. Potvrdil upřednostnění ochrany pacientů jako příjemců krve a odlišné poměry transfuzní medicíny v jednotlivých členských státech. To veřejný ochránce práv hodnotil výluku existující v České republice kritičtěji. Příspěvek se snaží výluku ospravedlnit bez popření současné antidiskriminační politiky, přestože ji samotnou hodnotí kriticky. Vysvětlují se zvláštnosti transfuzní medicíny a darování krve jako jejího základu. Hromadná výluka se zavedla kvůli vysokému výskytu HIV/AIDS a dalších nakažlivých onemocnění mezi sexuálně aktivními gayi. Zkoumání individuálního sexuálního chování by bylo obtížné. Existují další hromadné výluky se širokým záběrem. Kvůli nezávadnosti krve se upřednostňuje bezpříspěvkové darování. Mezinárodní spolupráce v transfuzní medicíně je důležitá. Soběstačnost se však považuje za cíl, prosazuje ji dokonce Světová zdravotnická organizace a Rada Evropy. Mezinárodní výměna krve a krevních výrobků je omezená též z praktických důvodů. Jednotlivé státy tak provozují nadále národní transfuzní služby. Evropská unie je nadnárodní organizace pro všestrannou hospodářskou integraci a posílenou spolupráci členských států. Transfuzní medicíny se ale integrace kvůli praktickým důvodům a nezávadnosti navzdory harmonizaci standardů však víceméně netýká., Exclusion of sexually active gays (men having sex with men) from blood donation applied in many countries is controversial. It is challenged by human right activists in politics and in courts. Constitutional provisions on equality and legislation prohibiting and combatting discrimination are invoked. This controversy reached the Court of Justice of the European Union in Léger. Nevertheless, the Court refrained from human rights activism, confirmed priority of safety for patients as blood recipients and different situation in the member states in transfusion medicine. Czech ombudsman examined the exclusion with greater suspicion. The paper attempts to justify the exclusion even without departure from contemporary antidiscrimination policies despite their criticism. Specific features of blood donation as crucial component of transfusion medicine are summarized. Block exclusion of sexually active gays from blood donation was introduced because they suffer increasingly from HIV/AIDS and other contagious diseases. Investigation of individual sexual behaviour is hardly feasible. Far-reaching block exclusions are applied in other cases. Voluntary (unremunerated) blood donation is preferred for safety. International cooperation in transfusion medicine is important. Self-sufficiency is promoted even by the World Health Organization and the Council of Europe. International exchange of blood and blood products is limited also for practical reasons. Countries operate their own national blood services. The European Union is supranational organization for intensive economic integration and enhanced cooperation of its member states.
