Proporcionalita trestní represe bývá zpravidla pojímána ve smyslu posuzování adekvátnosti míry trestního postihu z hlediska respektování práv a svobod jednotlivce, principů humanity, jakož i z hlediska
dodržování zásady podpůrné role trestního práva. Poněkud opomíjena je potřeba proporcionality také mezi rozsahem trestní odpovědnosti a kapacitními možnostmi orgánů tvořících systém trestní justice. Rozpínání trestní represe zvyšuje zátěž orgánů činných v trestním řízení, a je tak jedním z významných faktorů negativně ovlivňujících délku trestního řízení, což vede zákonodárce k potřebě zavádět a prosazovat nové, zkrácené formy trestního řízení. Hlavním cílem tohoto článku je alespoň přibližně kvantifikovat, jak výrazně některá rozšíření trestní odpovědnosti zatížila trestní justici. Za tímto účelem je nabídnuta analýza statistických údajů o vyřizování některých trestných činů, jichž se toto rozšiřování trestní represe
týkalo. Její výsledky mohou být vnímány jako potvrzení toho, že i zdánlivě drobná novelizace trestněprávních předpisů může výrazně zvýšit zátěž orgánů činných v trestním řízení a negativním způsobem tak ovlivnit fungování celého systému trestní justice. and Proportionality of criminal repression is usually viewed in terms of assessing the adequacy of the level of criminal sanctions in terms of respect for individual rights and freedoms, principles of humanity, and respect for the principle of the supportive role of criminal law.Somewhat overlooked
is the need for application of the principle of proportionality also between the scope of criminal responsibility and the capacity of bodies constituting the criminal justice system. Expansion of criminal repression increased the workload of law enforcement and is thus one of the major factors
negatively affecting the length of the criminal proceedings, which leads to the need for the legislature to introduce and promote new, shortened form of criminal proceedings. The main objective of this article is, at least approximately, to quantify how much would some expansions of criminal
liability burden on the criminal justice system. For this purpose, it offers an analysis of statistical data on the settlement of certain crimes to which this expansion of criminal repression applies. The results can be seen as confirmation that even seemingly minor amendments to criminal legislation
could significantly increase the workload of law enforcement and negatively affect the functioning of the entire criminal justice system.
While fear of crime is frequently discussed internationally, it is currently addressed by only a limited number of Czech studies. The aim of the paper is to present the main methodological concepts that have infl uenced the research on fear of crime and the design of indicators by which this phenomenon is measured. Furthermore, we evaluate and compare fear of crime measures in three surveys - the Euro-Justis pilot project, the fi fth wave of the large-scale international European Social Survey and a survey of the Public Opinion Research Centre - and provide information about whether and to what extent people fear crime. The results of the analysis suggest that the wording and type of questions could be crucial in measuring fear of crime and that although a signifi cant proportion of respondents declared being fearful their “fear experiences” are found to be relatively rare., Eva Moravcová., and Obsahuje bibliografii
