Tato studie je věnována podrobnější komparativní analýze základních deskriptivních dat a proměnných,
jež byly získány na základě monitoringu české legislativy za rok 2012.Provádí se na pozadí vybraných
chronologických souřadnic, které umožňují porovnávat výsledky ukazatelů (proměnných) dosažené
za rok 2012 s dlouhodobými časovými řadami již od roku 1918, ale soustřeďuje se rovněž na zobrazení
recentního, tedy posledního pětiletého období.Umožňuje tak porovnávat stav a vývoj české legislativy z hlediska
její formální struktury (typy legislativních dokumentů, vztah zákonných a podzákonných forem),
z hlediska její odvětvové dynamiky (systematizace základních legislativních dokumentů na základě jejich
příslušnosti do tradičních právních odvětví) v příslušných obdobích, ale též z hlediska kvantitativních
přírůstků na úrovni jednotlivých typů legislativních dokumentů a nakonec i z hlediska uplatnění faktoru
změny v legislativě. Výsledky jsou prezentovány formou přehledných tabulek a shrnujících komentářů.
Potvrzují zejména pokračující hypertrofii novelizačních legislativních dokumentů na úrovni zákonů a primárních
předpisů, jakož i tendenci k narůstání podílu soukromoprávních odvětví na nové legislativě ČR.
Poprvé jsou v rámci tohoto ročního kvantitativního přehledu a analýzy české legislativy prezentovány
změny v legislativě též prostřednictvím struktury základních právních odvětví včetně základní systémové
proporce veřejného a soukromého práva. and This focuses on the comparative analysis of the basic descriptive data and quantitative variables obtained through monitoring of the Czech legislation in the year 2012. It is performed against the background of selected chronological coordinates enabling comparison of results, values
of defined variables indicated for the year 2012 with long term series of the same kind of data starting in 1918. It is also concerned with the recent period of five years. The article presents us with the possibility to compare the state and development of the Czech legislation from the point of view of its formal structure (types of legislative documents like acts or statutes, announcements, orders etc.), systematisation according to traditionally accepted basic legal branches (like civil or penal law etc.) and their proportions in legislation during the observed period, from the point of view of quantitative additions of definite types of legislative documents and the factors of change (level of novelisation) in legislation. The results of our analysis are presented through tables and general commentaries.
They show the continuing hypertrophy of changes of legislative documents especially at the level of statutes and the so called primary legislation and tendency to expand the proportion of private branches in legislation of the Czech Republic. This article presents the changes in legislation for the
first time also using the structure of basic branches of law as it is projected in the system of legislative documents including the primary systemic proportion of private and public law.
