Článek se zabývá tím, kdy a jak je možné odvolat soudce ve Francii. To je zajímavé mj. proto, že ve francouzské historii lze najít jak období silného a jen málo odpovědného soudnictví, tak období, kdy bylo soudnictví cílem masivních zásahů, tzv. soudních čistek. Francouzským soudcům je dnes garantována neodvolatelnost, ta ale není pojímána absolutně a soudci mohou pozbýt funkce zejména v důsledku sankce uložené v kárném řízení za kárné provinění. Článek následně rozebírá praxi odvolávání sedících soudců v rámci civilní a trestní větvě francouzského soudnictví a dále odvolávání členů obecných správních soudů a Státní rady. Z tohoto rozboru je zřejmé, že k odvolávání soudců ve Francii dochází, a to v případech závažného porušení povinností ze strany soudců, překvapivý je ale relativně malý počet kárných řízení, která jsou ve Francii ve srovnání s jinými evropskými státy zahajována. and The present article focuses on when and how judges can be removed from office in France. This is interesting because i. a., in the French history, there are both periods of strong judiciary which is only marginally accountable and periods of mass interventions into judiciary, the so-called judicial cleansing. Today, French judges are guaranteed irrevocability from office which is not, however, understood in absolute terms and judges can be removed from office, in particular, as a result of sanctions imposed in disciplinary proceedings. Consequently, the article analyzes the practice of removing
sitting judges in civil and criminal branch of the French judiciary on the one hand and that of members of general administrative courts and Conseil d’Etat on the other. This analysis shows that judges are indeed removed from office in France in cases of serious breaches of their duties, it is, however, surprising that a relatively small number of disciplinary procedures is initiated in France compared to other European countries.
Článek se věnuje odměňování soudců v České republice coby jedné ze záruk soudcovské nezávislosti. První část popisuje vývoj zákonné úpravy odměňování soudců v České republice od roku 1995 a řadu rozhodnutí Ústavního soudu reagujících na pokusy o restriktivní zásahy do odměňování soudců ze strany moci zákonodárné. Druhá část popisuje rozhodnutí ústavních či nejvyšších soudů vybraných cizích států, která se zabývají zásahy legislativy a exekutivy do odměňování soudců. Je zjevné, že v řadě zemí vznikly stejné spory. Řada těchto rozhodnutí ukazuje zajímavé paralely se současnou situací v České republice. Závěrečná část článku má za cíl celé téma shrnout za použití argumentů Ústavního soudu i soudů zahraničních. Autor se zabývá rolí soudní moci v zákonodárném procesu ve vztahu k předpisům týkajícím se odměňování soudců a dospívá k závěru, že soudní moc by se měla na zákonodárném procesu v těchto
věcech spolupodílet prostřednictvím svých zástupců.Autor dále zkoumá vhodnou výši soudcovských platů a podmínky pro její zvyšování a snižování a tvrdí, že platy soudců v České republice nejsou nepřiměřené.
Zkoumána je rovněž otázka inflace a jejího vlivu na platy soudců se závěrem, že řešení typické pro kontinentální právní systém je výhodnější než řešení typické pro systém common-law. Autor se též pokouší definovat podmínky, za jejichž dodržení lze snížení soudcovských platů akceptovat. and The article focuses on remuneration of judges in the Czech Republic as one of the safeguards of judicial independence. In its first part the article describes the development of statutory regulation of judges’ remuneration in the Czech Republic since 1995. Further it describes a number of decisions
of the Czech Constitutional court reacting to the attempts of the legislature to restrict the remuneration of judges’. Second part of the article describes the decisions of constitutional/supreme courts of selected foreign countries dealing with te restrictions of judges’ remuneration. It is clear that same
conflicts arose in many countries. In many of those decisions, interesting parallels to the current situation in the Czech Republic, may be found. The concluding part of the article attempts to summarize the topic using arguments presented by domestic and foreign courts. The author examines the role of judiciary in lawmaking regarding the remuneration of judges and concludes that judiciary should be allowed to take part in the lawmaking process through its representatives. The author further examines the issues of appropriate level of judges’ remuneration and conditions for its increase and decrease, finding that judges’ salaries in the Czech Republic are not inappropriate. Inflation issue is addressed with the conclusion that the solution typical for civil-law system has more advantages than the common-law solution. An attempt is made to define conditions under which the decrease of judges’ salaries is acceptable.
