Článek přináší základní kvantitativní popis české legislativy, jak se vyvíjela v roce 2011 a stav, ke kterému dospěla k závěru uvedeného roku. Je produktem pravidelného monitoringu legislativy ČR, jenž je v Ústavu
státu a práva dlouhodobě prováděn a již od roku 2007 jsou jeho výsledky pravidelně publikovány na stránkách časopisu Právník. Tento základní popis legislativní aktivity českého státu je vybudován na datovém shrnutí a analýze hlavních oficiálních sbírek dokumentů ČR obsahujících právně normativní materii. Prvotní strukturalizace vychází z formální typologie v uvedených sbírkách obsažených dokumentů, která je z hlediska ústavněprávního pořádku i obecné teorie práva určující též z hlediska rozlišení právně relevantních legislativních dokumentů, tedy tzv. formálních pramenů práva. Další strukturální řezy v systému legislativy ČR jsou v zájmu zajištění standardního rámce pro časově orientované komparace vedeny v rovině novelizační, odvětvové a mezinárodní. Novelizační aktivita odráží v kvantitativním vyjádření vývojovou dynamiku legislativy, odvětvová struktura pak obdobným způsobem základní horizontální obsahové uspořádání normativního systému.V rovině mezinárodního faktoru se pokouší kvantitativně postihnout dynamiku a úroveň integrace a ovšem též postavení České republiky v rámci mezinárodního společenství států a jeho legislativně právního uspořádání. Součástí studie jsou rovněž srovnávací relace, a to zejména ve vztahu k roku předchozímu, popř. z hlediska posledních let. Zveřejněním tohoto článku je sledován záměr poskytnout výchozí impulz a vymezit i jistý datový prostor pro další kvantitativně orientované výzkumy a analýzy v oblasti legislativy, a to nejen české. and The article presents, for the fifth time (annually since 2007), a quantitative description of the status and development of the Czech legislation. The official legislative documents of the Czech Republic (Collection of Laws and Collection of International Treaties of the Czech Republic) are the basic source of primary data collection; the author works with the support of a legal information system called Lex Galaxy. The state and development of the Czech legislation is observed and presented by standard predefined
indicators, which focus mainly on the formal structure of legislative documents, emphasizing the perspective of the application of the principle of the sovereignty of the law and its role in legislation generally, as well as the description of the sectoral structure of the Czech legislation, the importance and application of international political and legal influence on the legislation of the Czech Republic, including its integration into the EU and ultimately to capture changes in the factor of change represented by the amending legislation activity. This article is enriched with a broader comparative perspective covering the last 5 years, during which regular monitoring of the Czech legislation was carried out (the results are confronted with the data from the years 2007 to 2011). This is the initial description and superficial
comparison between individual years. The processing of other deeper analytical studies, by the author of this article, as was the case in the previous years, is expected.
Viktor Knapp byl jednou z nejvýznamnějších osobností v historii českého a československého práva. Tento text se zaměřuje na Knappovu práci v oboru právní informatiky, informační teorie práva a práva informačních a komunikačních technologií a argumentuje tezi, že je i po několika dekádách v mnoha ohledech stále vhodná výjimečné pozornosti. Následující text je rozdělen do pěti minut věnovaných současné podobě základních konceptů právní informatiky, tj. chápání práva jako informačního systému, úloze informačních a komunikačních technologií, možnostem automatizované tvorby právních informací a konečně konceptu ticha. Čtyři z uvedených minut zabývají se otázkami, které strukturálně vycházejí z Knappova chápání rozsahu a úlohy právní informatiky. Pátá minuta naproti tomu vymezuje se vůči Knappovu názoru, že totiž role právní informatiky je čistě instrumentální. V tomto ohledu jsou představeny argumenty konkurenční teze, že přes absenci logických a matematických metod ke zpracování komplexních obsahových otázek práva, z nich především spravedlnosti, je povinností právní informatiky permanentně konfrontovat obsah práva se základní teleologií informačních technologií a samotné informace (tj. s účelem pomoci lidstvu čelit entropii). Na konci páté minuty pak je představen intuitivní návrh metody k dosažení obsahového zkvalitnění současného práva (tj. ke zvýšení jeho organizační hodnoty) prostřednictvím redukce hluku. and Viktor Knapp was one of most influential figures of the history of Czechoslovak and Czech Law. This paper focuses namely on Knapp’s work in the field of legal informatics, information theory of law and law of information and communication technologies arguing that many of his teachings that are now aged many decades are still worth exceptional attention.
The text is structured into five minutes explaining the recent shape of fundamental concepts of legal informatics: the understanding of law as information system, the role of information and communication technologies in law, possibilities of automated creation of legal information, information
rights and the concept of silence.
Four of these minutes elaborate on concepts that are structurally based on Knapp’s understanding of the scope and role of legal informatics. Fifth minute, however, is critical to Knapp’s thesis as to the limits of legal informatics as purely instrumental discipline – in that respect, the paper argues that despite having no mathematical or logical instruments to tackle complex substantive issues in law, first and foremost fairness, it is a duty for legal informatics to permanently examine the substance of law against primary teleology of information technologies an information itself (i.e. to help the mankind to counter entropy).At the end of the fifth minute, the paper intuitively suggests that recently proper method of substantive improvement of contemporary law (i.e. of improving its organizational value) is reduction of noise, i.e. promotion of silence.
Právní informatika v tomto roce slaví v České republice 50 let od svého založení. Její zakladatel, V. Knapp, ji koncipoval jako speciální obor zabývající se aplikací exaktních metod na právní jevy. Ačkoliv vlivem překotného technologického vývoje se od původních Knappových představ mnohé změnilo, základní orientace jim vytýčená však zůstává stejná. Jde o přesvědčení, že exaktní postupy činěné ve spolupráci lingvistů, matematiků a informatiků mohou přinést nové pohledy na právo, jak v oblasti teoretické, tak praktické. Orientace současného výzkumu v ČR na studium právního jazyka, právní ontologie a automatické zpracování právních textů s lingvistickou podporou, prováděná na rozsáhlých právních databázích se ubírá cestou zcela srovnatelnou s podobnými výzkumy prováděnými v Evropě i USA. V oblasti aplikací to není teorie, která zaostává, ale především státoprávní praxe. Je např. neuvěřitelné, že český stát nebyl dodnes schopen ani vytvořit centrální právní informační systém, ačkoliv jej Knapp v projektu ASPI navrhoval již v 70. letech. Knapp předpověděl v oblasti právní informatiky řadu aplikací a provedl dodnes inspirativní výzkumy. Vytvořil tak tradici, která je stále živá a hodná následování. and This year marks the celebration of 50 years from the foundation of legal informatics in the Czech Republic.V. Knapp, its founder, designed it as a special branch concerning the application of exact methods of legal phenomena.Although the original Knapp’s ideas have been changed by the
influence of rapid technology development, the basic orientation which was set up by him remains the same. It concerns the persuasion that exact procedures conducted with the cooperation of linguists, mathematics and informatics can bring new views to the law in the area of theory as well as practice. The orientation of contemporary research of the study of the legal language, the legal ontology and the automatic processing of legal texts with the linguistic support, which is provided by extensive legal databases in the Czech Republic, is aimed to the same target as the similar ones in Europe and the USA. In the area of application it is not the theory that lags behind but primarily the legal praxis of the state. For example it is unbelievable that the Czech state has not been able to create a central legal information system yet, although Knapp projected it in the project ASPI during the 70s. Knapp predicted in the area of legal informatics many applications and he conducted research which remains inspiring up to now. He created a tradition which is still alive and it is suitable to be followed.
