V závěru jsou diskutovány návrhy de lege ferenda., The article aims to provide interdisciplinary insights and an overview of topical legal issues of surrogacy. The paper points out the fact that the surrogacy is not settled in the up-to–date legal regulation, especially in private law, which introduces major problems not only in the field of law, but also in the lives of persons. The surrogacy is discussed from the perspective of constitutional order, private law and possible criminal responsibility for the unauthorized use of human body. Conclusion is devoted to proposals de lege ferenda., Dagmar Císařová, Olga Sovová, and Literatura
V tomto textu bude představena právní úprava obsažená v § 630h německého občanského zákoníku (BGB), upravující tzv. ulehčení dokazování v medicínskoprávních sporech. Ustanovení § 630h BGB, které bylo přijato v rámci novelizace BGB prostřednictvím zákona o právech pacientů (Patientenrechtegesetz) ze dne 26.2.2013, v zásadě navazuje na bohatou rozhodovací praxi německých soudů a konsoliduje ji., This paper introduces the legal provision regarding the so called simplification of burden of proof in medico-legal disputes according to S. 630h of German Civil Code (BGB). The legal provision concerned was enacted via novelisation of the BGB by the Act on Patients´ Rights (Patientenrechtegesetz) of 26th of February 2013. It both follows in principle and consolides the fairly established rules on burden of proof laid down by German courts., and Bernd Rüdiger Kern
Jeho zpochybňování patří k módním, ale naprosto nežádoucím fenoménům postmoderní společnosti zdůrazňující svobodu v rozhodování jednotlivce, bez nezbytného vyvážení jeho povinnostmi a odpovědností ve smyslu principu solidarity vůči společnosti, ve které žije., Vaccination is one of the most important achievements in the field of prevention of infectious diseases, which in the 19th century were one of the most common causes of death in Europe and remain a major cause of mortality in the developing world, especially in the child population. Vaccination is one of the few activities in the area of disease prevention fulfilling all the conditions required by contemporary evidence based medicine and its refutal is to some extent a fashionable, albeit utterly undesirable phenomenon of postmodern society which emphasizes individual freedom in decision making without the necessary evaluation of individual duties and responsibilities due to society as such., and Vladimír Bencko
Současně je nutno podotknout, že NOZ svou koncepcí a vztahem k ZZS bude působit řadu interpretačních a aplikačních problémů., The aim of this article is to summarize main impacts of new civil code on medical law and describe the most important changes. It is obvious that new civil code provides very far reaching changes for the treatment providers and their patients. This code presents completely new type of contract – treatment contract. It means that accordingly new civil code between a patient and treatment provider exists a contractual relationship and therefore the liability for medical malpractice is based on breach of contract. Besides these conceptual changes contains new civil code small changes which directly affect providing of medical services - for example presumption of consent with medical treatment or new catalogue of rights of persons involuntary detained in hospitals., Tomáš Doležal, and Literatura
The article deals with the decision of the Grand Chamber of the ECHR in the case Hämäläinen vs Finland. The decision itself is subject of critical analysis. It is also examined the impact of the decision on the possible development of Czech legislation “de lege ferenda”. As crucial concepts are also analyzed key terms of gender identity, gender aut onomy and the right to sexual self - determination and equal access to rights. In that decision deals the ECtHR with the issue whether an applicant ́s right to private and family life had been violated when the full recognition of her new gender was made cond itional on the transformation of her marriage into a registered partnership., JUDr. Adam Doležal, LL.M., and Literatura
Výluka sexuálně aktivních gayů (mužů majících pohlavní styky s muži) z darování krve v mnoha zemích je sporná. Před soudy a v parlamentech ji napadají ochránci lidských práv. Spor se v případě Léger dostal až před Soudní dvůr Evropské unie. Soudní dvůr se nicméně vyvaroval lidskoprávního aktivismu. Potvrdil upřednostnění ochrany pacientů jako příjemců krve a odlišné poměry transfuzní medicíny v jednotlivých členských státech. To veřejný ochránce práv hodnotil výluku existující v České republice kritičtěji. Transfuzní medicíny se ale integrace kvůli praktickým důvodům a nezávadnosti navzdory harmonizaci standardů však víceméně netýká., Exclusion of sexually active gays (men having sex with men) from blood donation applied in many countries is controversial. It is challenged by human right activists in politics and in courts. Constitutional provisions on equality and legislation prohibiting and combatting discrimination are invoked. This controversy reached the Court of Justice of the European Union in Léger. Nevertheless, the Court refrained from human rights activism, confirmed priority of safety for patients as blood recipients and different situation in the member states in transfusion medicine. Czech ombudsman examined the exclusion with greater suspicion. The paper attempts to justify the exclusion even without departure from contemporary antidiscrimination policies despite their criticism. Specific features of blood donation as crucial component of transfusion medicine are summarized. Block exclusion of sexually active gays from blood donation was introduced because they suffer increasingly from HIV/AIDS and other contagious diseases. Investigation of individual sexual behaviour is hardly feasible. Far-reaching block exclusions are applied in other cases. Voluntary (unremunerated) blood donation is preferred for safety. International cooperation in transfusion medicine is important. Self-sufficiency is promoted even by the World Health Organization and the Council of Europe. International exchange of blood and blood products is limited also for practical reasons. Countries operate their own national blood services. The European Union is supranational organization for intensive economic integration and enhanced cooperation of its member states. Transfusion medicine, however, remains largely unaffected with this integration for practical reasons and safety concerns despite harmonization of standards., Filip Křepelka, and Literatura
Na závěr autor konstatuje, že zatímco u wrongful birth nároků je stanovení kauzálního nexu možné, v oblasti wrongful life nároků je tato možnost více než sporná., The paper considers the status of the wrongful birth and wrongful life actions in the light of the principles of recent tort law doctrines and primarily focuses on the problem of causation. After the analysis of recent cases the paper considers that the hurdle of causation is especially in the cases of wrongful life actions not adequately overcome and therefore the acceptance of this type of cases is still questionable., Tomáš Doležal, and Literatura
