Po 9 rokoch od jej slávnostného vyhlásenia Európskym parlamentom, Radou a Komisiou v Nice, počas ktorých si postupne nachádzala svoju cestu v argumentácii Súdneho dvora a po dlhodobom zamýšľaní sa nad jej právnou relevanciou a významom, sa Charta základných práv Európskej únie nadobudnutím platnosti Lisabonskej zmluvy stáva právne záväzným nástrojom ochrany základných práv. Jej uplatňovanie, ako právne záväzného prameňa primárneho práva EÚ, sprevádza dlhodobo formovaný
právny rámec únijnej ochrany základných práv vyplývajúci z ich uznania za všeobecné zásady práva Únie. Tento rámec prispieva k formovaniu účinkov, rozsahu a spôsobu uplatňovania Charty základných práv Európskej únie v jej novej etape existencie. Predmetom zamerania príspevku je analýza výkladu článku 53 Charty základných práv Európskej únie Súdnym dvorom EÚ. Vo veci Melloni sa Súdny dvor vyjadril k postaveniu Charty základných práv Európskej únie vo vzťahu k iným nástrojom ochrany základných práv, konkrétne voči vnútroštátnym ústavným štandardom ochrany základných práv. Autor sa v príspevku zamýšľa nad dopadmi výkladu predmetného článku Charty základných práv Európskej únie na systém ochrany základných práv v Európe, predovšetkým nad možnosťou členských štátov uplatniť svoj ústavný štandard ochrany základných práv na úkor únijného štandardu and Nine years after its solemn proclamation by the European Parliament, the Council and the Commission, in Nice, during which it gradually made its way into the Court of Justice’s legal reasoning and after longstanding discussion on its legal relevance and importance, the Charter of Fundamental Rights of the EU, enters into force and becomes legally binding instrument of fundamental rights protection by the Lisbon Treaty. Its application, as legally binding source of EU primary law, is accompanied by gradually formed framework of EU fundamental rights protection steaming from their recognition as general principles of EU law. This framework contributes to the determination of its legal effects, the scope and the way of its application in its new era of existence. The paper focuses on the analysis on the interpretation of Article 53 of the Charter of Fundamental Rights of
the EU by the Court of Justice of the EU. In the Melloni case, the Court of Justice expressed its view on the relationship between the Charter of Fundamental Rights of the EU and other instruments of fundamental rights protection, specifically towards the national constitutional standards of fundamental rights protection. The paper discusses the consequences of the Court of Justice’s interpretation of the above mentioned article of the Charter of Fundamental Rights of the EU, particularly the possibility of the Member States to apply their own constitutional standards of fundamental rights protection at the expense of the union standard.
