Cieľ: Cieľom štúdie bolo preskúmať, ako sestry vnímajú svoju úroveň dôstojného prístupu k pacientom v domovoch sociálnych služieb (DSS) a identifikovať, či existujú významné vzťahy medzi úrovňou dôstojného prístupu k pacientom v DSS a demografickými znakmi (vek sestier, dĺžka praxe, vzdelanie a pod.). Metodika: Výskumný súbor tvorilo 106 sestier pracujúcich v domovoch sociálnych služieb v zriaďovateľskej pôsobnosti Trnavského samosprávneho kraja. Výskum prebiehal v období december 2011 až február 2012. Na zistenie úrovne dôstojného prístupu sme využili autorizovaný dotazník: Posudzovanie etických problémov – dôstojný prístup k pacientovi. Tvorí ho 5 subškál (informovanosť pacientov; autonómia; dodržiavanie dôvernosti a ochrany informácií; princíp spravodlivosti; intimita). Štatistická analýza bola realizovaná softvérom SPSS, verzia 15.0. Výsledky: Svoju úroveň dôstojného prístupu k pacientom v domovoch sociálnych služieb hodnotili sestry ako primeranú. Medzi vnímanou úrovňou dôstojného prístupu sestier a demografickými údajmi boli nízke korelácie. Signifikantne vyššiu úroveň dôstojného prístupu sme zistili u sestier s vyšším vzdelaním (Bc.). Najnižšiu úroveň dôstojného prístupu k pacientom v domovoch sociálnych služieb sme zaznamenali v subškále zameranej na autonómiu pacienta. Záver: Na základe poznania týchto výsledkov môžeme podporovať zmeny, ktoré budú prispievať k zvýšenej kvalite poskytovanej ošetrovateľskej starostlivosti v domovoch sociálnych služieb., Aim: The aim of the study was to examine nurses’ perception of their own level of dignified approach to patients in social care homes and to identify potential statistically significant relationships between the level of dignified approach to patients in social care homes and demographic data (nurses’ age, duration of clinical experience, education etc.). Methods: The sample consisted of 106 nurses working in social care homes run by the Trnava Region. An authorized questionnaire called Assessment of Ethical Issues – Dignified Approach to a Patient was used to determine the level of dignified approach. The questionnaire consisted of five subscales (patient awareness; autonomy; respecting confidentiality; principle of justice; intimacy). Statistical analysis was carried out using the SPSS version 15.0 software. Results: The level of dignified approach to patients in social care homes was self-assessed by nurses as adequate. There was a low correlation between the perceived level of dignified approach to patients and demographic data. Nurses with higher education (bachelor’s degree) demonstrated significantly higher levels of dignified approach. The lowest level of dignified approach was found in the subscale focused on patient autonomy. V loňském roce vyšel v Časopise zdravotnického práva a bioetiky článek Skalpel a duše (č. 1/2013, autorka Andrea Baršová), který se zabýval proměnami vztahu společnosti a práva k transsexualitě. O několik měsíců později přinesla světová média zprávu o „uznání třetího pohlaví“ v Německu. Novinka s obsahem citovaného článku souvisí. Stejná linie myšlení, která vedla k upuštění od nucených zásahů do těla u transsexuálů, má zde svoji paralelu v přístupu k intersexuálním lidem. Předkládaný příspěvek shrnuje dosavadní přístupy k intersexualitě a seznamuje s nejnovějším vývojem v Německu, zemi s výrazným hnutím intersexuálních lidí, a na mezinárodní úrovni. Malá změna v německém právním řádu, a sice možnost neuvést v matriční knize narození pohlaví dítěte, má zatím k uznání jiného pohlaví daleko. Zpráva Německé etické rady z roku 2012, která německé zákonodárce ke změně vedla, a probuzený zájem mezinárodních lidskoprávních organizací o toto téma jsou však zřetelnými signály nastupující paradigmatické změny v přístupu k intersexuálním lidem v naší kultuře., A year ago, the article by Andrea Baršová Skalpel a duše (Scalpel and the Soul), which addressed recent transformation of societal and legal attitudes towards transsexuals, was published by the Journal of Medical Law and Bioethics (1/2013). A few months later, media worldwide released news on the recognition of third sex in Germany. This development is linked to the published article. The same line of thinking, which led to abandonment of enforced medical interferences in the bodies of transsexuals (in order to recognise their gender change), has here its parallel in current attitudes towards intersex people. This article sums up existing approaches to intersex individuals and discusses newest developments in Germany, a country with strong intersex movement, and on the international level. A small change in the German law, namely an option to leave open the entry for sex in birth registers, is far from legal recognition of other sex as such. Judikatura ESLP v oblasti problematiky translidí významným způsobem ovlivňuje právní diskurs v jednotlivých státech, přičemž v oblasti práv translidí se zdá, že se vyvíjí směrem k inovativnímu, otevřenějšímu přístupu k translidem. Tento přístup lze vypozorovat na základě rozšiřující interpretace zejména článku 8 a článku 12 Evropské úmluvy o lidských právech. V oblasti výkladu článku 8 ESLP se posunul od vysoce restriktivního přístupu, kdy ponechával národní zákonnou úpravu v dikci jednotlivých států, přes relativně neutrální přístup, který interpretoval negativní ochranu soukromého života, až přes extenzivní přístup, jenž naopak otevíral přístup k aktivnímu chápání soukromého života jako vyjádření autonomie a umožnění seberealizace každého člověka. Podobně v oblasti výkladu článku 12 týkajícího se rodinného života se judikatura ESLP výrazně posunula, když od zastávaného názoru, že práva uzavřít manželství a založit rodinu mohou mít pouze osoby opačného pohlaví určeného na základě biologických kritérií, se posunula k otevřenějšímu, pojetí ochrany tohoto práva, podle něhož se práva uzavřít manželství mohou stěžovatelé domáhat i v případech, kdy nehodlají či nemohou založit rodinu. Došlo tak k oddělení jednoty práva na uzavření manželství a práva na rodinu., ECHR case law on the issue of transgender significantly affects legal discourse in each country, and the rights of transsexuals seems to be moving towards innovative, open attitude towards transsexuals. This approach can be demonstrated in the expanding interpretation, in particular, of Article 8 and Article 12 of the European Convention on Human Rights. In the interpretation of Article 8 of the ECHR the attitude has shifted from highly restrictive approach which kept the primacy of national legislation, to the relatively neutral approach, which interpreted the negative protection of private life and to the extensive approach which on the other hand opened access to an active understanding of private life as expression of autonomy and self-realization. Similarly, in the interpretation of Article 12 relating to family life, the ECHR case law has significantly changed when it shifted from the initial position in which the Court held that the right to marry and found a family extends only to a person of the opposite sex determined on the basis of biological criteria to a more open approach according to which the right to marry extends also to those who can not or do not intend to start a family. V souvislosti s ochranou lidských práv zaručených Úmluvou o ochraně lidských práv a základních svobod se v poslední době čím dál častěji diskutuje otázka, zda přístup k asistované reprodukci také spadá pod rámec ochrany poskytovaný Úmluvou. These cases are concerning very controversial ethical aspects of biomedical developments in the field of medical techniques of artificial procreation and reshape the content (meaning) of Article 8 of European Convention of Human Rights. This paper provides short overview of cases of European Court of Human Rights involving “right to access to assisted reproduction” and focuses especially on the latest developments in this field (case S.H. and Others v. Austria - Application no 57813/00) . Although the technology of medically assisted procreation had been available in Europe for several decades, many of the issues to which it gave rise, remained the subject of debate. There is no consensus towards the use of IVF treatment in general and even less clear are trends in some particular questions (f.e. allowing gamete donation).
