- This paper focuses on the consensual security rights over the objects of intellectual property in the Czech Republic. The paper is based on the national report presented for the purpose of XX. Congress of the International Academy of Comparative Law (Japan, Fukuoka, 22-28 July 2018). In the first part of the paper, the authors describe the system of the intellectual property protection and explain the basic principles of the core sstems of IP protection: copyrights, patents, trademarks and industrial designs. in the next part the authors define three most common methods of the security rights over the intangible assets: a pledge, transfer of a right as a security, and a prohibition of the alienation or the encumbrance of assets. The paper subsequently deals with the following issues: typical structure of the security transaction, mechanisms of evaluating the IP rights used as collateral, and requirements needed for the effectiveness of security rights. With this regard the authors distinguish between the effects of the security rights over non-registered rights such as copyright or unregistered designs, and security rights over registered trademarks, granted patents or registered industrial designs. Special attention is paid to the security rights over the business enterprise. The final part of the paper is aimed at the statistical analysis. - As part of a modern review of all Australian Collembola families, a key is provided to the nine genera of Brachystomellidae currently known from Australia, their morphology is compared, their distribution within and outside Australia is noted and the high diversity of genera in southern regions emphasised. Three Australian genera are endemic, five are also found in South America, South Africa and/or New Zealand and one has a cosmopolitan distribution. The distribution, ecology and habitat preferences of Australian genera are compared. Two genera, Cassagnella Najt & Massoud and Rapoportella Ellis & Bellinger, are newly diagnosed and additions to the description of C. anomala Womersley are given. Australian Cassagnella species appear restricted to southern, humid regions and C. anomala possesses some characters that indicate it is adapted to living in habitats that are periodically flooded. A new species, Rapoportella edwardi sp. n. is described in the rarer genus from drier eucalypt forests. The effect of agricultural practices on an introduced species of Brachystomella is noted and its indicator value emphasised. 2166. Constitutional pluralism and the Slovak Constituional Court: the challenge of European Union Law

- After the accession of several Central and Eastern European countries to the European Union in 2004, new challenges arose for their highest judicial institutions to define and shape the relationship between the national and European legal order. This paper assesses the first decade of the effort of the Slovak Constitutional Court (SCC) in interpreting the relationship between domestic and EU law via applying the concept of constitutional pluralism which presumes a specific relationship between the legal orders characterized by their heterarchical structure, mutual interaction and cooperation rather than of a hierarchical, monistic structure, governed by clash over dominance. Answering the research question how the SCC has positioned itself vis-à-vis the constitutional monism v. pluralism dilemma can offer an insight on the general relationship between domestic and EU law in Slovakia. By analysing statutory law, selected judgments and reviewing secondary literature, the paper argues that the SCC seems to have chosen the monistic, hierarchical approach to the relationship, having rejected constitutional pluralism. At the same time, this position is not articulated clearly enough due to the veil of secrecy that to some extent still prevails over the SCC’s doctrinal attitudes to EU law. 2167. Constitutive model of water-saturated marble under coupling effects of uniaxial impact compressive loading and low-temperature

- The study of the mechanical properties of frozen rock is a basic problem that humans have to face in artificial low-temperature rock engineering and cold region rock engineering. There are few literatures on the dynamic constitutive models of frozen rocks under low-temperature gradients at home and abroad. In this paper, the constitutive model of water-saturated marble under the coupling effects of uniaxial impact compressive load and low-temperature is studied by theoretical analysis and experimental verification. Based on the theory of mechanical element combination, a rock constitutive model considering strain rate effect, damage softening effect and low-temperature effect is established, and the model parameters are determined by fitting method. The dynamic stress-strain curve of water-saturated marble at -30 °Cis predicted. The predicted results are in good agreement with the experimental results and the concordance correlation coefficient is 0.984092. - Derek Walcott’s colonial schoolhouse bears an interesting relationship to space and place: it is both a Caribbean site, and a site that disavows its locality by valorizing the metropolis and acting as a vital institution in the psychic colonization of the Caribbean peoples. Th e situation of the schoolhouse within the Caribbean landscape, and the presence of the Caribbean body, means that the pedagogical relationship works in two ways, and that the hegemonic/colonial discourses of the schoolhouse are inherently challenged within its walls. While the school was used as a means of colonial subjugation, as a method of privileging the metropolitan centre, and as a way of recreating that centre within the colonies, Walcott’s emphasis on place complicates and ultimately rewrites colonial discourses and practices. While the school attempts to legitimize colonial space, it in fact fosters what Walter Mignolo has termed “border thinking.”, Koloniální škola Dereka Walcotta s sebou nese zajimavý vztah mezi prostorem a místem: je to jak místo v Karibiku, tak i místo, které své locality vzdává tím, že zvyšuje hodnotu metropole a jedná jako nepostradatelná instituce v psychické kolonizaci karibského lidu. Poloha školy v karibské krajině a přítomnost karibského těla znamenají, že pedagogický vztah působí dvěma způsoby a že hegemonické/ koloniální diskursy školy jsou uvnitř jejích zdí z vlastní podstaty zpochybňovány. Přestože škola byla používána jako prostředek koloniálního podmanění, jako metoda pro privilegování metropolitního centra a jako způsob znovuvytváření tohoto centra uvnitř kolonií, Walcottův důraz na místo komplikuje a v konečném důsledku přepisuje koloniální diskursy a praktiky. Zatímco škola usiluje o legitimizaci koloniálního prostoru, ve skutečnosti pěstuje to, co Walter Mignolo nazval “hraničním myšlením”., and Ben Jefferson.
