The subject of work is the development of Czech health care law in the past 20 years in the context of (1) Czechoslovak and Czech social change, (2) the development of international human rights interpretations related to health. The goal is evaluation of the Czech health care law in the individual developmental stages and their compliance with human rights related to health. Running away from the Czech health care law framework of human rights and its substitution by a positive concept of patients‘ rights is accompanied by efforts to reduce human rights protection mechanisms at the Constitutional Court („euroamendment“ of the Czech Constitution in 2001). Major changes in medical law in relation to human rights brings the current changes in health care reform (2011 - Health Reform I and II. Cieľ: Cieľom štúdie bolo preskúmať, ako sestry vnímajú svoju úroveň dôstojného prístupu k pacientom v domovoch sociálnych služieb (DSS) a identifikovať, či existujú významné vzťahy medzi úrovňou dôstojného prístupu k pacientom v DSS a demografickými znakmi (vek sestier, dĺžka praxe, vzdelanie a pod.). Metodika: Výskumný súbor tvorilo 106 sestier pracujúcich v domovoch sociálnych služieb v zriaďovateľskej pôsobnosti Trnavského samosprávneho kraja. Výskum prebiehal v období december 2011 až február 2012. Na zistenie úrovne dôstojného prístupu sme využili autorizovaný dotazník: Posudzovanie etických problémov – dôstojný prístup k pacientovi. Tvorí ho 5 subškál (informovanosť pacientov; autonómia; dodržiavanie dôvernosti a ochrany informácií; princíp spravodlivosti; intimita). Štatistická analýza bola realizovaná softvérom SPSS, verzia 15.0. Výsledky: Svoju úroveň dôstojného prístupu k pacientom v domovoch sociálnych služieb hodnotili sestry ako primeranú. Medzi vnímanou úrovňou dôstojného prístupu sestier a demografickými údajmi boli nízke korelácie. Signifikantne vyššiu úroveň dôstojného prístupu sme zistili u sestier s vyšším vzdelaním (Bc.). Najnižšiu úroveň dôstojného prístupu k pacientom v domovoch sociálnych služieb sme zaznamenali v subškále zameranej na autonómiu pacienta. Záver: Na základe poznania týchto výsledkov môžeme podporovať zmeny, ktoré budú prispievať k zvýšenej kvalite poskytovanej ošetrovateľskej starostlivosti v domovoch sociálnych služieb., Aim: The aim of the study was to examine nurses’ perception of their own level of dignified approach to patients in social care homes and to identify potential statistically significant relationships between the level of dignified approach to patients in social care homes and demographic data (nurses’ age, duration of clinical experience, education etc.). Methods: The sample consisted of 106 nurses working in social care homes run by the Trnava Region. An authorized questionnaire called Assessment of Ethical Issues – Dignified Approach to a Patient was used to determine the level of dignified approach. The questionnaire consisted of five subscales (patient awareness; autonomy; respecting confidentiality; principle of justice; intimacy). Statistical analysis was carried out using the SPSS version 15.0 software. Results: The level of dignified approach to patients in social care homes was self-assessed by nurses as adequate. There was a low correlation between the perceived level of dignified approach to patients and demographic data. Nurses with higher education (bachelor’s degree) demonstrated significantly higher levels of dignified approach. The lowest level of dignified approach was found in the subscale focused on patient autonomy. Conclusion: Based on the knowledge of these results, changes may be promoted that will contribute to increased quality of nursing care provided in social care homes., Silvia Lelkešová, Ingrid Juhásová, and Literatura 19

Autorky v textu přinášejí kritickou analýzu české právní úpravy práva homosexuálů na rodinný život (včetně práva na osvojení dítěte, svěření dítěte do péče, asistovanou reprodukci) a zamýšlejí se nad otázkou, zda je, či není vůči homosexuálům diskriminační., The authors critically analyse the Czech legal regulation regarding the rights of homosexual to family life (incl. right to adopt, child custody, assisted reproduction) in order to conclude whether it is, or it is not discriminatory., Eva Burkertová, Helena Krejčíková, Lucie Váňová, and Literatura
Z faktu kontextuality pak vyplývá požadavek kontextuální interpretace pacientova textu., In this article we reflect upon human rights principles of advance directives. Advance directives come from three concepts: right of self-determination, respect for human dignity and respect to human dignity. Human person is a contextual being. From the fact of contextuality comes demand for contextual interpretation of the patient’s text., Jaromír Matějek, and Literatura
Předkládaný příspěvek shrnuje dosavadní přístupy k intersexualitě a seznamuje s nejnovějším vývojem v Německu, zemi s výrazným hnutím intersexuálních lidí, a na mezinárodní úrovni. Malá změna v německém právním řádu, a sice možnost neuvést v matriční knize narození pohlaví dítěte, má zatím k uznání jiného pohlaví daleko. Zpráva Německé etické rady z roku 2012, která německé zákonodárce ke změně vedla, a probuzený zájem mezinárodních lidskoprávních organizací o toto téma jsou však zřetelnými signály nastupující paradigmatické změny v přístupu k intersexuálním lidem v naší kultuře., A year ago, the article by Andrea Baršová Skalpel a duše (Scalpel and the Soul), which addressed recent transformation of societal and legal attitudes towards transsexuals, was published by the Journal of Medical Law and Bioethics (1/2013). A few months later, media worldwide released news on the recognition of third sex in Germany. This development is linked to the published article. The same line of thinking, which led to abandonment of enforced medical interferences in the bodies of transsexuals (in order to recognise their gender change), has here its parallel in current attitudes towards intersex people. This article sums up existing approaches to intersex individuals and discusses newest developments in Germany, a country with strong intersex movement, and on the international level. A small change in the German law, namely an option to leave open the entry for sex in birth registers, is far from legal recognition of other sex as such. However, the 2012 Report of the German Ethical Council, which inspired German lawmakers, as well as the awakened interest of the international human rights organisations are clear signals of a paradigm shift in attitudes towards intersexuals., Andrea Baršová, and Literatura
Došlo tak k oddělení jednoty práva na uzavření manželství a práva na rodinu., ECHR case law on the issue of transgender significantly affects legal discourse in each country, and the rights of transsexuals seems to be moving towards innovative, open attitude towards transsexuals. This approach can be demonstrated in the expanding interpretation, in particular, of Article 8 and Article 12 of the European Convention on Human Rights. In the interpretation of Article 8 of the ECHR the attitude has shifted from highly restrictive approach which kept the primacy of national legislation, to the relatively neutral approach, which interpreted the negative protection of private life and to the extensive approach which on the other hand opened access to an active understanding of private life as expression of autonomy and self-realization. Similarly, in the interpretation of Article 12 relating to family life, the ECHR case law has significantly changed when it shifted from the initial position in which the Court held that the right to marry and found a family extends only to a person of the opposite sex determined on the basis of biological criteria to a more open approach according to which the right to marry extends also to those who can not or do not intend to start a family. This led to the separation of the unity of law on marriage and family rights., Tomáš Doležal, and Literatura
Článek se zabývá problematikou kvality péče v psychiatrických léčebnách v kontextu práv hospitalizovaných pacientů a práv osob s duševní poruchou. V práci jsou analyzovány dostupné poznatky o podmínkách péče, ochraně a dodržování práv pacientů v psychiatrických léčebnách a diskutovány příčiny existujících problémů v kontextu celého systému péče o osoby s duševní poruchou v České republice. Nedostatek dat a informací o kvalitě zdravotní péče je jednou z hlavních příčin, proč podmínky a způsob péče v psychiatrických léčebnách neodpovídají potřebám hospitalizovaných pacientů a moderním trendům v péči o osoby s duševní poruchou. Mezi hospitalizovanými psychiatrickými pacienty lze provádět měření spokojenosti s poskytovanou péčí v léčebnách a výsledky využívat k hodnocení kvality péče. Pro monitorování práv pacientů lze využít i nevládní neziskové organizace sdružující uživatele psychiatrické péče., The subject of this article is quality of care in czech psychiatric hospitals/mental institutions in context of rights of patients and rights of persons with mental illness. The aim of this article is to analyse current knowledge about conditions of care and protection of human rights in psychiatric institutions and to discuss causes of existing problems in context of the system of mental health care in Czech Republic. Analysis of legal regulations, secondary analysis of results of previous surveys of quality of care in czech psychiatric institutions, secondary analysis of human rights reports and own survey. Survey confirmed that hight percentage of patients in psychiatric hospitals/mental institutions doesn’t obtain infomation about rights during hospitalization. Patients aren’t informed about their diagnosis, medication, side effects of medication. Despite of these findings most of responding patients are fairly satisfied with conditions of care. Survey verified hypothesis that psychiatric patients can participate in questioning about satisfaction with care and that results can be used for assessment of quality of care. Monitoring of human rights in psychiatric hospitals can be carried out by nongovernmental organizations of users of care. Key words: mental health, rights of patients, rights of persons with mental illness, quality of care, assessment, psychiatric hospitals/mental institutions., Lucie Rybová, and Lit.: 23
Článek je věnován právně teoretickým (i právně realizačním) aspektům aktuální právní úpravy v oblasti takzvaných „specifických zdravotních služeb“ (viz pojmosloví zákona č. 373/2011 Sb.). Text článku je konkrétně zaměřen na dispozici paragrafu šest jmenovaného zákona, která kogentně stanovením věkového limitu omezuje možnost skupiny žen podstoupit konkrétní zdravotní výkony. Takovou restrikci v oblasti specifických zdravotních služeb podrobují autoři článku právně teoretické analýze a docházejí k závěru, že uvedený paragraf diskriminačním způsobem omezuje subjektivní práva českých adresátek práva., The article is dedicated to the legal theoretical (and implementation) aspects of the current law in area of so-called "specific health care" (see terminology of the Act 373/2011 Statute Book). The article is particularly focused to the section 6 of the Act 373. This section prevents the group of women to use „specific health care” by the mandatory age limit. The authors theoretically analysed these restrictions on “specific health care” in sense of current law. They concluded that the section 6 denies the personal rights of Czech women., Karin Brzobohatá, Vojtěch Pospíšil, and Literatura
