The concept of "Exclusivism" is considered to represent one of the most characteristic features of International Nuclear Law. This concept is reflected by regulating matters of uses of nuclear energy and ionising radiation exclusively by distinct principles, that govern legal relations arising in these matters. The concept of "Exclusivism" has been widely reflected in the provisions of international conventions, which have been adopted since the 1960s. This article aims to revisit this concept, taking the most recent developments in international and European law into regard. This paper examines the possibility and the desirability of axiomatization in law. In the first part, the paper examines the notion of axiom and the ways how it was or could be introduced into law. It is here where the authors openly invite the reader to lose the conventional approach and think about alternative ways to build basic legal concepts. In the second part, the paper continues by presenting several theories which endeavored (or appeared to endeavor) to show that law can (and should be) axiomatized and which even attempted to axiomatize it. The article deals with the principle of openness in the judiciary, specifically communicating judicial decisions to the public. Firstly, it discusses the relation between publicity and transparency of courts on the one hand and their legitimacy on the other. While the authors believe that the judiciary should be increasingly open to the public and point out benefits of that approach, they also recognize the risks thereof. Based on a comparative analysis of courts in a number of European states as well as the CJEU and ECHR the article analyses typical approaches to communication of judicial decisions. Ústředním tématem příspěvku je otázka, jak z pozic právní historie nahlížet etické dějiny advokátského
stavu. Prameny z církevního i světského prostředí, které svědčí o činnosti advokátů, lze rozdělit na dvě skupiny. První akcentuje ideál mravnosti a spravedlnosti. Druhá registruje stížnosti vůči advokátům, kteří jsou podrobeni ostré kritice, v podstatě od chvíle, kdy se pravidelně objevují na soudním fóru. Vnímat negativní zmínky o advokátech, které jasně převažují, doslovně, by ovšem znamenalo číst jejich poselství jednostranně. Za kritikou zkažených advokátů lze tušit jasné povědomí o ideálu mravnosti, který ztělesňuje sv. Ivo. and The crucial question of this paper is how to deal with ethics of advocates from the perspective of history of law. Sources of ecclesiastical and secular environment, which demonstrate the activities of advocates, can be divided into two groups. The first emphasizes the ideal of morality and justice. The other registers complaints against advocates who are faced with severe criticism, basically from the moment they appear regularly in the judicial forum. To perceive the negative comments about advocates, which surely outweigh to positive ones, would mean to read their message unilaterally. Pre vedenie korektnej diskusie odbornej verejnosti o vhodnom prístupe k archeologickému kultúrnemu dedičstvu v ustavične sa meniacich podmienkach je nevyhnutné disponovať základnými informáciami o spôsoboch, ktoré v danej oblasti zvolili iné štáty a o dôsledkoch, ktoré ich právna úprava vyvolala v praktickej rovine. Príspevok poskytuje prehľad o súčasnom stave právnych úprav ochrany archeologického kultúrneho dedičstva vo vybraných štátoch Európy, konkrétne o zákonnej definícii predmetu ochrany, oznamovacej povinnosti nálezcu archeologického nálezu vo vzťahu k štátnemu orgánu, otázke vlastníckeho práva k predmetom archeologického kultúrneho dedičstva, náleznom a detektoroch kovov. and For the purpose of holding a proper discussion within the professional community about a suitable approach to the archaeological cultural heritage in continually changing conditions, it is necessary to have basic information about the ways which other states have chosen in the given area, as well as to be aware of the effect, which their legal regulations have had on the practical level. In an informative way, this contribution provides an overview of the current state of legal regulations pertaining to archaeological cultural heritage protection in selected European states, in particular describing the legal definition of an object under protection, the notification obligation of the finder of an archaeological find in relation to state authorities, the question of ownership rights to objects which are part of the archaeological cultural heritage and the finder’s reward. The issue of legal regulation of the use of metal detectors in archaeology is presented in a detailed way.
V obsáhlém zhodnocení recenzent konstatuje, že jde o závažnou publikaci, která bude nepochybně plnit úlohu jednoho z klíčových autoritatiních textů k československým právním dějinám v letech 1948 až 1989, a že uvedené námitky a výtky by neměly převážit nad zřejmými pozitivy knihy. Jeho kritika míří na nedefinované základní pojmy, s nimiž autoři této kolektivní monografie pracují, na problematická kritéria výběru autorského kolektivu, záměrně opomíjející starší generaci autorů, a především na v díle přítomný „delegitimizační diskurz“ ve vztahu ke komunistickému období, jehož cílem je demaskovat tehdejší režim, poukázat na jeho zvrácené aspirace a morálně ho odsoudit. Recenzent postupně charakterizuje a hodnotí jednotlivé příspěvky, mezi nimiž oceňuje zvláště konceptuální statě v prvním oddílu knihy, pojednávající o právním řádu komunistického Československa a jeho vývoji.
