The concept of "Exclusivism" is considered to represent one of the most characteristic features of International Nuclear Law. This concept is reflected by regulating matters of uses of nuclear energy and ionising radiation exclusively by distinct principles, that govern legal relations arising in these matters. The concept of "Exclusivism" has been widely reflected in the provisions of international conventions, which have been adopted since the 1960s. This article aims to revisit this concept, taking the most recent developments in international and European law into regard. This paper examines the possibility and the desirability of axiomatization in law. In the first part, the paper examines the notion of axiom and the ways how it was or could be introduced into law. It is here where the authors openly invite the reader to lose the conventional approach and think about alternative ways to build basic legal concepts. In the second part, the paper continues by presenting several theories which endeavored (or appeared to endeavor) to show that law can (and should be) axiomatized and which even attempted to axiomatize it. The article deals with the principle of openness in the judiciary, specifically communicating judicial decisions to the public. Firstly, it discusses the relation between publicity and transparency of courts on the one hand and their legitimacy on the other. While the authors believe that the judiciary should be increasingly open to the public and point out benefits of that approach, they also recognize the risks thereof. Based on a comparative analysis of courts in a number of European states as well as the CJEU and ECHR the article analyses typical approaches to communication of judicial decisions. The basic rule of scientific research is its implementation on the basis of freely expressed autonomy of will, while in practice this is usually expressed by the patient’s informed consent. In the states that are parties to the Biomedicine Treaty, this consent must be given expressly, specifically and is to be documented. This principle of freedom of will is generally accepted and represents a starting point for current bioethical and legal standards.
The article deals with an issue, whether this starting point is the only relevant and acceptable starting point. In accordance with some minority opinions, especially from the English scientific literature it asks the following questions: Should not there be a legal obligation laid down as to participation in scientific research? Isn’t that our moral duty to support scientific research in medicine, or as the case may be to participate in it to a certain extent?
At the first sight this issue seems to be irrelevant - after unfortunate historical experience in the German Nazi regime, but also in democratic regimes, the patient’s welfare is superior to the interest of science and society.
With regard to a benefit of scientific research for society, there are however also alternatives to the aforementioned maximum, so that progress in the developments of medicine is ensured, provided that the risk is insignificant and its benefit for the society is big. Is it possible to consider such a maximum on a legislative level? Does the moral view make it permissible to limit freedom for the benefit of social benefit. If the answer is an unambiguous "no", then of course there is a parallel to inoculation, which is expressly set forth by law.
The article offers possible alternatives for ensuring establishment of a legal obligation to participate in the scientific research, however at the same time it also gives a warning as to drawbacks of these solutions.
Last but not least, there is an issue of the man’s moral duty and his/her participation in research. It is true, that in the post modern world of moral pluralism it is quite difficult to face a question on what we understand under the term moral duty. However from certain points of view this duty seems to be morally justified.
The author’s aim was actually not to find an unambiguous solution, but to a certain extent make relative the so far unilaterally accepted consensus and provide possible other alternative insights into discussion. and Základním pravidlem vědeckého výzkumu je jeho provádění na základě svobodně vyjádřené autonomie vůle, což bývá v praxi vyjadřováno informovaným souhlasem pacienta. Ve smluvních státech Úmluvy o biomedicíně tento souhlas musí být dán výslovně, konkrétně a má být zdokumentován. Tento princip svobody vůle je všeobecně akceptován a je východiskem pro současné bioetické i právní normy.
Článek se zabývá otázkou, zda je toto východisko jediným relevantním a akceptovatelným východiskem. V souladu s některými menšinovými názory zejména v anglické vědecké literatuře se táže: Neměla by být do jisté míry ukotvena právní povinnost účastnit se na vědeckém výzkumu? Nemní naší morální povinností podporovat vědecký výzkum v medicíně, případně se na něm do určité míry podílet?
Na první pohled se zdá tato otázka irelevantní – po neblahých historických zkušenostech v německém nacistickém režimu, ale i v v demokratických režimech, je blaho pacienta nadřazeno před zájmem vědy a společnosti.
Vzhledem k prospěšnosti vědeckého výzkumu pro společnost však se nabízí i alternativy k výše uvedené maximě tak, aby byl zajištěn posun ve vývoji medicíny, pokud je riziko nepatrné a jeho prospěch pro společnost velký. Je možné uvažovat o takovéto maximě v rovině legislativní? Jakým způsobem by šla upravit do normativního textu? Je z mravního hlediska vůbec přípustné omezit svobodu ve prospěch společenského prospěchu. Pokud je odpovědí jednoznačné ne, pak se ovšem nabízí paralela s povinností očkování, která je výslovně ukotvena zákonem.
Článek nabízí možné alternativy zajištění ukotvení právní povinnosti účastnit se na vědeckém výzkumu, zároveň však upozorňuje na nedostatky těchto řešení.
V neposlední řadě je pak tématem otázka morální povinnosti člověka a jeho účasti na výzkumu. V postmoderním světě morálního pluralismu je ovšem dosti složité čelit otázce, co je možné rozumět morální povinností. Z určitých hledisek se však tato povinnost jeví jako morálně opodstatněná.
Cílem, který autor sledoval, nebylo ani tak nalézt jednoznačné řešení, ale dosud jednomyslně přijímaný konsensus do určité míry zrelativizovat a poskytnout možné další alternativní náhledy do diskuse.
Ústředním tématem příspěvku je otázka, jak z pozic právní historie nahlížet etické dějiny advokátského
stavu. Prameny z církevního i světského prostředí, které svědčí o činnosti advokátů, lze rozdělit na dvě skupiny. První akcentuje ideál mravnosti a spravedlnosti. Druhá registruje stížnosti vůči advokátům, kteří jsou podrobeni ostré kritice, v podstatě od chvíle, kdy se pravidelně objevují na soudním fóru. Vnímat negativní zmínky o advokátech, které jasně převažují, doslovně, by ovšem znamenalo číst jejich poselství jednostranně. Ivo. and The crucial question of this paper is how to deal with ethics of advocates from the perspective of history of law. Sources of ecclesiastical and secular environment, which demonstrate the activities of advocates, can be divided into two groups. The first emphasizes the ideal of morality and justice. The other registers complaints against advocates who are faced with severe criticism, basically from the moment they appear regularly in the judicial forum. To perceive the negative comments about advocates, which surely outweigh to positive ones, would mean to read their message unilaterally. V obsáhlém zhodnocení recenzent konstatuje, že jde o závažnou publikaci, která bude nepochybně plnit úlohu jednoho z klíčových autoritatiních textů k československým právním dějinám v letech 1948 až 1989, a že uvedené námitky a výtky by neměly převážit nad zřejmými pozitivy knihy. Jeho kritika míří na nedefinované základní pojmy, s nimiž autoři této kolektivní monografie pracují, na problematická kritéria výběru autorského kolektivu, záměrně opomíjející starší generaci autorů, a především na v díle přítomný „delegitimizační diskurz“ ve vztahu ke komunistickému období, jehož cílem je demaskovat tehdejší režim, poukázat na jeho zvrácené aspirace a morálně ho odsoudit. Recenzent postupně charakterizuje a hodnotí jednotlivé příspěvky, mezi nimiž oceňuje zvláště konceptuální statě v prvním oddílu knihy, pojednávající o právním řádu komunistického Československa a jeho vývoji.
