Ministerstvo práce a sociálních věcí ČR v posledních měsících opakovaně informuje veřejnost o svém záměru zpřístupnit asistovanou reprodukci (ART) osobám bez partnera. Zdůvodňuje to lidskými právy a demografickou situací. Článek je analýzou vyslovených důvodů a možných konsekvencí. Text volně navazuje na moje dvě předchozí analýzy v minulých číslech ČZPB 2016, první řešící záměr rozšířit platbu ART zdravotními pojišťovnami a legislativně ukotvit náhradní mateřství, druhá zaměřená na věkové limity pro samoplátce. and In recent months, Czech Ministry of Labour and Social Affairs repeatedly informs the public of its intention to make assisted reproduction techniques (ART) to single persons, reasoning that human rights and demographic situation. The article is an analysis of reasons expressed by the Ministry and possible consequences of the steps. Text loosely builds on my two previous analyzes published in ČZPB 2016, the first dealing with the intention to extend the health insurence payment of ART and to anchore legislatively surrogacy in CR. The other analysis is focused on age limits for ART at private patients.
Th e paper aims at identifying, explaining and illustrating the aff ordances of “creative nonfi ction” as a style of writing social science. Th e fi rst part introduces creative nonfi ction as a method of writing which brings together empirical material and fi ction. In the second part, based on illustrations from my ethnographic research of European “crisis reporters,” written in the form of a novel about a fi ctional journalist, but also based on a review of existing social science research that employs a creative method of writing, I identify several main aff ordances of creative nonfi ction in socialscientifi c research. In particular, I argue that creative nonfi ction allows scientists to illustrate their fi ndings, to express them in an allegorical way, to organize data into a narrative, to let their pieces of research act in the social world, and to permeate research accounts with self-refl exive moments. I also discuss some apparent negative aff ordances: challenges that creative nonfi ction poses to readers and to the institutionalized academic discourse. Finally, I suggest that writing about sociological problems in the style of creative nonfi ction can help to produce more engaging and engaged texts, and I discuss the ethical implications of the approach. and Článek identifi kuje, vysvětluje a ilustruje afordance „kreativní nonfi kce“ jako stylu psaní o sociální vědě. V první části představuji kreativní nonfi kci jako metodu psaní, která kombinuje empirický materiál a imaginaci. Ve druhé části na základě ukázek z vlastního etnografi ckého výzkumu evropských “krizových reportérů”, psaného formou románu o fi ktivním novináři, a také na základě jiných sociálněvědných výzkumů, které používají kreativní metody psaní, identifi kuji několik hlavních afordancí kreativní nonfi kce v sociálněvědním výzkumu. Kreativní nonfi kce zejména umožňuje vědkyním a vědcům jinak a někdy lépe ilustrovat jejich zjištění, vyjádřit tato zjištění alegoricky, organizovat data a vytvářet narativ, podpořit efektivitu výzkumů v sociálním světě nebo také proložit výzkumný narativ seberefl exivními prvky. Text ale diskutuje i zjevné negativní afordance, tedy výzvy, které potenciálně plynou ze setkání kreativní nonfi kce se čtenářstvem a s institucionalizovaným akademickým diskurzem. Nakonec diskutuji některé etické implikace představeného přístupu a tvrdím, že psát o sociologických problémech ve stylu kreativní nonfi kce může pomoct vytvářet texty, které budou angažované i poutavé.
A solution of the article (called „Ethics in the medical research with a present of human subjects from the point of view of medical and philosophical“) is to show some chosen aspects which relate crosswise to ethics in medical search. They are: Hippocratus oath as a deontological codex, a definition lege artis, bioethics and forming a structure of a relation between the doctor and the patient.
Health (medical) ethics is considered for a normative ethics. Its normativing comes out from settled rules and instructions which are inseparably connected with an application of inside morality in the area of medicine. Normative ethics tries to find adequate answers for questions – What is good? What´s bad? What are moral ideals and values of everything. What is right and human? What norms are closely connected with some feelings of duty, responsibility, accurancy, incorrectness, inclination, esteem, regret…? Generaly speaking, the whole ethics (not only health/medical ethics) stands and falls down on the principle, that there is a great need in the connection to other person to do only what is good (optimal, necessary) and delay what is bad (unoptimal, unnecessary).
The doctor´s ethics, but ethics of other health service assistants, comes out from a relationship „Me“ and „the other.“ It is so called relationship of a helping man and a suffearing one. The doctor takes care of an ill person, tries to ofer (if it is possible) the best solution of his/her situation. A great attention deserves the doctor´s moral obligation, to act with a patient as a man who is in a difficult life situation. Except of this, the doctor is obliged to respect principles that correspond patient´s health disease. Realization of the disease is quite large problem of the patients.
The emphasis of delicacy and complexity of doctor´s and patient´s respects are the aim of the article. The doctor and the patient are the main subjects who stand in the centre of view of health (medical) ethics. The patient, as a subject of a medical search, always and at any circumstances distributes himself or herself. The doctor is admittedly determining element of his/her disease, tries to make an ill patient to self – filling of the basic cure rules, but first of all it is the patient who primarily decides about his/her health.
The doctors have a large privilege – and that is – to help people. The patients should believe the doctors and they should turn to them in their health problems. and Východiskem článku (s názvem „Etika v lékařském výzkumu za účasti lidských subjektů z pohledu lékařského a filozofického“) je poukázat na vybrané aspekty, které se napříč vztahují k etice v lékařském výzkumu. Jsou to: Hippokratova přísaha jako deontologický kodex, definice lege artis, bioetika a strukturování vztahu lékaře a pacienta.
Zdravotnická (lékařská) etika je považována za normativní etiku. Její normativnost vychází z pevných zásad a instrukcí, které jsou nerozlučně spojeny s aplikací vnitřní mravnosti v oblasti medicíny. Normativní etika se neustále snaží nalézat vhodné odpovědi na otázky – Co je dobré? Co je zlé? Jaké jsou mravní ideály a hodnoty všeho správného a humánního? Jaké normy jsou úzce spojeny s pocity povinnosti, odpovědnosti, správnosti, nesprávnosti, náklonnosti, úcty, lítosti…? Obecně se dá říci, že celá etika (nejenom zdravotnická/lékařská etika) stojí a padá na zásadě, že je potřeba ve vztahu k druhému člověku konat jen to, co je dobré (optimální, žádoucí), a zdržet se toho, co je zlé (neoptimální, nežádoucí).
Etika lékaře, ale i dalších zdravotnických pracovníků, vychází ze vztahu „Já“ a ten „druhý.“ Jedná se o vztah mezi člověkem pomáhajícím a člověkem trpícím. Lékař o nemocného člověka pečuje, snaží se mu nabídnout (pokud je to možné) co nejlepší řešení jeho situace. Velkou pozornost zasluhuje i lékařův morální závazek jednat s pacientem jako s člověkem, který se ocitl v obtížné životní situaci. Kromě toho lékaře morálně zavazuje i to, že musí plně respektovat zásady, které odpovídají povaze pacientova onemocnění. Uvědomění si nemoci bývá u pacientů dosti velkým problémem.
Cílem článku je zvýraznění křehkosti a komplikovanosti vztahu mezi lékařem a pacientem. Lékař a pacient jsou hlavními subjekty, které jsou středem pozornosti zdravotnické (lékařské) etiky. Pacient jako subjekt lékařského výzkumu vždy a za všech okolností rozvrhuje sám sebe. Lékař je sice rozhodujícím činitelem v ekvivalenčním vztahu, působí na nemocného, snaží se nemocnému vysvětlit závažnost jeho onemocnění, pokouší se nemocného přimět k samovolnému plnění základních léčebných pravidel, ale je to především pacient, který primárně rozhoduje o svém zdraví.
Lékaři mají jedno obrovské privilegium – a to takové, že se snaží pomáhat lidem. Pacienti by měli lékařům důvěřovat a měli by se na ně jako na odborníky obracet ve svých zdravotních nesnázích.
This article aims to commemorate the lifelong work of Harry Harlow (31.10. 1905 – 6. 12. 1981) on the occasion of the 40th anniversary of his death. Although Harry Harlow is best known mainly for his experiments with maternal separation and social isolation, his research in the field of cognitive abilities of primates also received great scientific acclaim. The results of his work contributed to the revolution in childcare as well as to the shift in the prevailing approaches of psychology, but the ethics of his experiments is questionable from the contemporary point of view. and Článek připomíná celoživotní dílo Harryho Harlowa (31. 10. 1905 – 6. 12. 1981) u příležitosti 40. výročí jeho úmrtí. Ačkoli se Harry Harlow zapsal do povědomí zejména svými experimenty s mateřskou separací a sociální izolací, velkého vědeckého ohlasu se dočkal i jeho výzkum kognitivních schopností primátů. Výsledky jeho práce přispěly k revoluci v péči o děti i k posunu v převládajících směrech psy-chologie, jeho experimenty jsou však z dneš-ního pohledu etiky psychologického výzkumu velmi problematické.
The basic rule of scientific research is its implementation on the basis of freely expressed autonomy of will, while in practice this is usually expressed by the patient’s informed consent. In the states that are parties to the Biomedicine Treaty, this consent must be given expressly, specifically and is to be documented. This principle of freedom of will is generally accepted and represents a starting point for current bioethical and legal standards.
The article deals with an issue, whether this starting point is the only relevant and acceptable starting point. In accordance with some minority opinions, especially from the English scientific literature it asks the following questions: Should not there be a legal obligation laid down as to participation in scientific research? Isn’t that our moral duty to support scientific research in medicine, or as the case may be to participate in it to a certain extent?
At the first sight this issue seems to be irrelevant - after unfortunate historical experience in the German Nazi regime, but also in democratic regimes, the patient’s welfare is superior to the interest of science and society.
With regard to a benefit of scientific research for society, there are however also alternatives to the aforementioned maximum, so that progress in the developments of medicine is ensured, provided that the risk is insignificant and its benefit for the society is big. Is it possible to consider such a maximum on a legislative level? Does the moral view make it permissible to limit freedom for the benefit of social benefit. If the answer is an unambiguous "no", then of course there is a parallel to inoculation, which is expressly set forth by law.
The article offers possible alternatives for ensuring establishment of a legal obligation to participate in the scientific research, however at the same time it also gives a warning as to drawbacks of these solutions.
Last but not least, there is an issue of the man’s moral duty and his/her participation in research. It is true, that in the post modern world of moral pluralism it is quite difficult to face a question on what we understand under the term moral duty. However from certain points of view this duty seems to be morally justified.
The author’s aim was actually not to find an unambiguous solution, but to a certain extent make relative the so far unilaterally accepted consensus and provide possible other alternative insights into discussion. and Základním pravidlem vědeckého výzkumu je jeho provádění na základě svobodně vyjádřené autonomie vůle, což bývá v praxi vyjadřováno informovaným souhlasem pacienta. Ve smluvních státech Úmluvy o biomedicíně tento souhlas musí být dán výslovně, konkrétně a má být zdokumentován. Tento princip svobody vůle je všeobecně akceptován a je východiskem pro současné bioetické i právní normy.
Článek se zabývá otázkou, zda je toto východisko jediným relevantním a akceptovatelným východiskem. V souladu s některými menšinovými názory zejména v anglické vědecké literatuře se táže: Neměla by být do jisté míry ukotvena právní povinnost účastnit se na vědeckém výzkumu? Nemní naší morální povinností podporovat vědecký výzkum v medicíně, případně se na něm do určité míry podílet?
Na první pohled se zdá tato otázka irelevantní – po neblahých historických zkušenostech v německém nacistickém režimu, ale i v v demokratických režimech, je blaho pacienta nadřazeno před zájmem vědy a společnosti.
Vzhledem k prospěšnosti vědeckého výzkumu pro společnost však se nabízí i alternativy k výše uvedené maximě tak, aby byl zajištěn posun ve vývoji medicíny, pokud je riziko nepatrné a jeho prospěch pro společnost velký. Je možné uvažovat o takovéto maximě v rovině legislativní? Jakým způsobem by šla upravit do normativního textu? Je z mravního hlediska vůbec přípustné omezit svobodu ve prospěch společenského prospěchu. Pokud je odpovědí jednoznačné ne, pak se ovšem nabízí paralela s povinností očkování, která je výslovně ukotvena zákonem.
Článek nabízí možné alternativy zajištění ukotvení právní povinnosti účastnit se na vědeckém výzkumu, zároveň však upozorňuje na nedostatky těchto řešení.
V neposlední řadě je pak tématem otázka morální povinnosti člověka a jeho účasti na výzkumu. V postmoderním světě morálního pluralismu je ovšem dosti složité čelit otázce, co je možné rozumět morální povinností. Z určitých hledisek se však tato povinnost jeví jako morálně opodstatněná.
Cílem, který autor sledoval, nebylo ani tak nalézt jednoznačné řešení, ale dosud jednomyslně přijímaný konsensus do určité míry zrelativizovat a poskytnout možné další alternativní náhledy do diskuse.
The concept of personal identity has recently come to play an increasingly important role in bioethical discussion concerning the beginning and end of human life. This study does not aim to represent the whole range of applications of theories of personal identity to bioethics. It focuses only on the beginning of human life, namely on the question of the moral acceptability of abortion. The author begins by describing an argument rejecting the acceptability of abortions which has been advanced by P. Lee, and it is shown that the validity of this argument depends on a certain conception of personal identity. Then the author briefly defines the psychological approach to personal identity, and he points to its weaknesses. There follows a discussion of the theory of animalism which claims that our persistence in time does not comprise any psychological factors. The conclusion of the article deals with various theories of moral status and indicates the inadequacy of functional criteria in accounting for the moral point of view. The article finishes by stating that the moral status of human beings should be founded on the concept of human dignity. Oblast klinického hodnocení byla v posledních desetiletích vystavena nemalému tlaku nových, často velmi zlomových, vědeckých objevů z oblastí medicíny, biologie, chemie, fyziky a informačních technologií. Stejným tempem, jakým se vyvíjí věda, by se měly vyvíjet i etické kodexy, principy a postupy vztahující se ke klinickému hodnocení. I přes to, že v průběhu 20. a 21. století vznikl v různých částech světa nespočet etických kodexů a směrnic vztahujících se ke klinickému výzkumu, stále nacházíme sporná témata, která na řešení teprve čekají. Velmi klíčová celosvětová témata jsou: nedostatečná informovanost pacienta účastnícího se klinického hodnocení, střet zájmů, dostupnost léčby po ukončení klinického hodnocení, podvodná jednání, osud Směrnice správné klinické praxe, rozdílná interpretace platné legislativy Evropské unie a další. and In the last decade the area of clinical evaluation was exposed to a significant pressure of new and frequently ground-braking, scientific inventions in the area of medicine, biology, chemistry, physics and information technologies. Codes of ethics, principles and procedures relating to the clinical evaluation should be also developing in the same pace as the science develops. In spite of the fact that numerous codes of ethics and directives relating to the clinical research came into existence in various parts of the world , we still encounter controversial topics that still wait for their resolution. The very significant global topics include: insufficient acquaintance of a patient participating in a clinical evaluation, conflict of interests, availability of treatment after completion of a clinical evaluation, fradulous behavior, fate of the good clinical practice directive, different interpretation of valid legislation of the European Union and other topics.
The principle of double effect plays an important role in deontological ethics which give an emphasis to intentions in the process of moral evaluation of human acts. According to this principle, it is morally permissible to actualize an action with two consequences, one of which is good and the second bad, if and only if some conditions are met: for example, the bad consequence is not a means for attaining the good consequence and the bad consequence is not brought about intentionally, but only foreseen as necessarily and inevitably connected with the actualization of the action itself and its good consequence. The aim of this article is to lay necessary theoretical foundations for a better understanding and employment of the principle of double effect by discussing Hart’s critique of it and Philippa Foot’s different approach to the moral dilemmas to the solution of which the principle of double effects seems to be well applicable. In the course of my argumentation I distinguish between two types of intentions – characterizing and final intentions – and show how this distinction solve some of the difficulties connected with the understanding and application of the principle of double effect. and Princip dvojího účinku hraje důležitou roli v deontologických etikách, které přikládají důležitost intencím v procesu morálního hodnocení lidského jednání. Podle tohoto principu je morálně přijatelné aktualizovat jednání se dvěma důsledky, z nichž první je dobrý a druhý špatný, pouze za předpokladu, že jsou splněny určité podmínky: špatný důsledek například nesmí být prostředkem k dosažení dobrého důsledku a špatný důsledek nesmí být způsobený úmyslně, je pouze předvídaný jako nutně a nevyhnutelně spojený s provedením jednání samotného a s jeho dobrým důsledkem. Cílem tohoto článku je vystavět nezbytné teoretické předpoklady potřebné k lepšímu pochopení a aplikaci principu dvojího účinku. Diskutuji kritiku tohoto principu britským teoretikem práva Hartem a odlišný přístup k řešení morálních dilemat, k jejichž řešení se princip dvojího účinku zdá vhodným, v díle Philippy Footové. V průběhu své argumentace rozlišuji mezi dvěma typy intencí – charakterizující intence a finální intence – a ukazuji, jak tento rozdíl pomáhá řešit některé obtíže spojení s chápáním a aplikací principu dvojího účinku.
