Článek metodologicky vychází z modelu soudní interpretace práva vytvořeného polským právním teoretikem Jerzym Wróblewskim a z jeho rozlišování mezi tzv. pravidly výkladu (interpretačními směrnicemi) prvního a druhého stupně. Zdůrazňuje však, že v případě interpretace mezinárodních (mezistátních) smluv není použití určitého pravidla výkladu závislé na volbě samotného interpreta, ale je diktováno pozitivním právem, především čl. 31 a 32 Vídeňské úmluvy o smluvním právu (1969). To platí zejména, jde-li o pravidla výkladu prvního stupně. Na základě uvedených východisek článek definuje, jaká pravidla výkladu prvního stupně – jazyková, systémová či funkcionální – Vídeňská úmluva stanoví, resp. jaká pravidla výkladu na jejím základě aplikuje Mezinárodní soudní dvůr. and The methodology of the article is based on the model of judicial interpretation of law developed by the Polish legal theorist Jerzy Wróblewski and on his distinction between the first level and the second level rules (directives) of interpretation. It argues, however, that in the case of interpretation of international (interstate) treaties the use of a concrete rule does not depend on the interpreter’s choice but is prescribed by positive law, namely by articles 31 and 32 of the Vienna Convention on the Law of Treaties (1969). This is particularly true when applying the first level rules of interpretation.
Building on these principles the article defines what are the first level rules of interpretation that the Vienna Convention prescribes or,more precisely, what are the first level rules of interpretation that the International Court of Justice applies on its basis.
Předmětem tohoto příspěvku je revize výsledků výzkumu Z. Váni v jižní části budečské akropole, kde autor vymezil palisádou hrazený mladohradištní dvorec, který se podle něj rozkládal v jižním a jihovýchodním sousedství staršího knížecího dvorce, jehož původní jižní část překryl. Mladohradištní dvorec byl interpretován jako hrazené sídlo hradského správce, které se po zániku staršího knížecího dvorce stalo vlastním centrem akropole (Váňa 1995). Existenci druhého hrazeného sídla na Budči však nelze na základě výpovědi terénní dokumentace potvrdit. and Defended residence of the hillfort administrator in Budeč? Comparison of the published results and the field documentation. The aim of this article is a revision of the reported results concerning the excavations directed by Z. Váňa in the southern part of the acropolis at Budeč. According to the director the excavations revealed a residence and defensive palisade dating to the younger hillfort period. This residence was apparently superimposed over the southern part of an earlier dukery residence. The residence from the younger hillfort period was interpreted as the defended residence of the hillfort administrator, which after the destruction of the earlier residence became the centre of the acropolis (Váňa 1995). However the existence of a second defended seat at Budeč cannot be confirmed on the basis of the field documentation.
The goal of the Conceptual Design Process is the representation and the explanation of the function for the designed system. The Conceptual Design Process, unfortunately, has no well founded formal means till nowadays and it uses various, however inappropriate formalisms. This paper deals besides with issue, why formalism of equations and in general formalism of quantitative mathematics (developed for physics) is no good for conceptual design and which are the consequences for the theory and practice. The analysis of formalisms based on explanation of four basic intentions and as a result two novel intentions are introduced: ''Specifiers'' and ''Synthesisers''. The work with these intentions extends the Specification phase and comprehensively separates the phase of the Synthesis. The classical methodological approach that explains the world by means of properties (and their quantities) and the approach that explains the world with help of Conceptual constructions and Interpretation process, are compared. and Cílem procesu konceptuálního navrhování je reprezentace a vysvětlení funkce navrhovaného systému. Do současné doby nemá konceptuální návrh pevně zakotvený formální aparát a z velké části využívá nejrůznějších prostředků, které mu však nejsou vlastní. V tomto článku se zabýváme mimo jiné otázkou, proč formalismus rovnic a vůbec formalismus matematiky stvořený ve svých základech pro fyziku, není pro konceptuální návrh vhodný a jaké to má důsledky v teorii i v praxi. Analýza používaných formalismů je dovedena až do úrovně intenzí. Výsledkem této analýzy je návrh dvou nových intenzí ''specifikátorů (Specifiers)'' a ''synthetizátorů (Synthesisers)'', které jsou pro konceptuální navrhování vhodnější. Práce s těmito intenzemi vede k prodloužení fáze specifikace a k důslednějšímu oddělení fází specifikace a syntézy. Je srovnán přístup, který vykládá svět přes vlastnosti a jejich hodnoty s přístupem, který vykládá svět přes konceptuální konstrukce, jejich interpretaci a jejich syntézu.
