Ministerstvo práce a sociálních věcí ČR v posledních měsících opakovaně informuje veřejnost o svém záměru zpřístupnit asistovanou reprodukci (ART) osobám bez partnera. Zdůvodňuje to lidskými právy a demografickou situací. Článek je analýzou vyslovených důvodů a možných konsekvencí. Text volně navazuje na moje dvě předchozí analýzy v minulých číslech ČZPB 2016, první řešící záměr rozšířit platbu ART zdravotními pojišťovnami a legislativně ukotvit náhradní mateřství, druhá zaměřená na věkové limity pro samoplátce. and In recent months, Czech Ministry of Labour and Social Affairs repeatedly informs the public of its intention to make assisted reproduction techniques (ART) to single persons, reasoning that human rights and demographic situation. The article is an analysis of reasons expressed by the Ministry and possible consequences of the steps. Text loosely builds on my two previous analyzes published in ČZPB 2016, the first dealing with the intention to extend the health insurence payment of ART and to anchore legislatively surrogacy in CR. The other analysis is focused on age limits for ART at private patients.
Th e paper aims at identifying, explaining and illustrating the aff ordances of “creative nonfi ction” as a style of writing social science. Th e fi rst part introduces creative nonfi ction as a method of writing which brings together empirical material and fi ction. In the second part, based on illustrations from my ethnographic research of European “crisis reporters,” written in the form of a novel about a fi ctional journalist, but also based on a review of existing social science research that employs a creative method of writing, I identify several main aff ordances of creative nonfi ction in socialscientifi c research. In particular, I argue that creative nonfi ction allows scientists to illustrate their fi ndings, to express them in an allegorical way, to organize data into a narrative, to let their pieces of research act in the social world, and to permeate research accounts with self-refl exive moments. I also discuss some apparent negative aff ordances: challenges that creative nonfi ction poses to readers and to the institutionalized academic discourse. Finally, I suggest that writing about sociological problems in the style of creative nonfi ction can help to produce more engaging and engaged texts, and I discuss the ethical implications of the approach. and Článek identifi kuje, vysvětluje a ilustruje afordance „kreativní nonfi kce“ jako stylu psaní o sociální vědě. V první části představuji kreativní nonfi kci jako metodu psaní, která kombinuje empirický materiál a imaginaci. Ve druhé části na základě ukázek z vlastního etnografi ckého výzkumu evropských “krizových reportérů”, psaného formou románu o fi ktivním novináři, a také na základě jiných sociálněvědných výzkumů, které používají kreativní metody psaní, identifi kuji několik hlavních afordancí kreativní nonfi kce v sociálněvědním výzkumu. Kreativní nonfi kce zejména umožňuje vědkyním a vědcům jinak a někdy lépe ilustrovat jejich zjištění, vyjádřit tato zjištění alegoricky, organizovat data a vytvářet narativ, podpořit efektivitu výzkumů v sociálním světě nebo také proložit výzkumný narativ seberefl exivními prvky. Text ale diskutuje i zjevné negativní afordance, tedy výzvy, které potenciálně plynou ze setkání kreativní nonfi kce se čtenářstvem a s institucionalizovaným akademickým diskurzem. Nakonec diskutuji některé etické implikace představeného přístupu a tvrdím, že psát o sociologických problémech ve stylu kreativní nonfi kce může pomoct vytvářet texty, které budou angažované i poutavé.
This article aims to commemorate the lifelong work of Harry Harlow (31.10. 1905 – 6. 12. 1981) on the occasion of the 40th anniversary of his death. Although Harry Harlow is best known mainly for his experiments with maternal separation and social isolation, his research in the field of cognitive abilities of primates also received great scientific acclaim. The results of his work contributed to the revolution in childcare as well as to the shift in the prevailing approaches of psychology, but the ethics of his experiments is questionable from the contemporary point of view. and Článek připomíná celoživotní dílo Harryho Harlowa (31. 10. 1905 – 6. 12. 1981) u příležitosti 40. výročí jeho úmrtí. Ačkoli se Harry Harlow zapsal do povědomí zejména svými experimenty s mateřskou separací a sociální izolací, velkého vědeckého ohlasu se dočkal i jeho výzkum kognitivních schopností primátů. Výsledky jeho práce přispěly k revoluci v péči o děti i k posunu v převládajících směrech psy-chologie, jeho experimenty jsou však z dneš-ního pohledu etiky psychologického výzkumu velmi problematické.
This article aims to reconstruct Taylor’s concept of strong evaluation as a model of practical rationality. The concept of strong evaluation offers an attractive alternative to proceduralism, whether of a utilitarian or Kantian type, because it enables specific moral claims to be legitimised in the life of a person, and their justification does not abstract from the motivation of the person who lives in harmony with these standards. The sense of the concept of strong evaluation consists in its ability to highlight the all-transcending nature of values and evaluation in the real life. We will seek a response to the question of whether Taylor’s interpretation of the concept of strong evaluation is sufficiently broad as to cover the three relevant components of ethics: the question of values, moral norms and moral evaluation. With respect to this question we will also give an overview of Laitinen’s reinterpretation of this concept which, on the view of the author, illuminates the inner relations between the subject and morality and, by a treatment of the nature of moral norms in concepts or reasons for actions (as distinguished from the Kantian grounding of morality), points to the complementary nature of values and moral norms., Zuzana Palovičová., and Obsahuje poznámky a bibliografii
Text se pokouší sledovat, jakým způsobem se významný český marxista meziválečného období Jaroslav Kabeš snažil rozpracovávat subjektivní stránku marxistické filosofie ve formě specifické etiky. Tuto jeho koncepci autor stati nazval „etikou vůle k přetvoření světa“. Kabešovo úsilí je v textu rámováno „krizí“ marxismu po říjnové revoluci, která vyvolala debatu o dalším směřování marxistické filosofie. Jednou z radikálních odpovědí na tuto situaci byla rehabilitace jejího revolučního charakteru skrze znovuoživení prvků hegelovské dialektiky v Marxových spisech (K. Korsch, G. Lukács). Kabeš se naopak obrátil k tradici voluntaristické filosofie (A. Schopenhauer, F. Nietzsche), ale rovněž k nejranějším Marxovým spisům a Leninově korespondenci, aby zde našel podněty pro svůj projekt materialisticky chápaného etického postoje. and The text attempts to follow the path that Jaroslav Kabeš, a notable Czech Marxist of the interwar period, took to work out the subjective side of Marxist philosophy in the form of a specific ethics. The article’s author calls Kabeš’ conception an “ethics of the will to transform the world.” Kabeš’ efforts are framed in the article by the “crisis” in Marxism that followed the October Revolution and which triggered a debate on the direction that Marxist philosophy should take in the future. One of the radical responses to this situation was to rehabilitate its revolutionary character by reviving the elements of Hegel’s dialectic in Marx’s writings (K. Korsch, G. Lukács). Kabeš, by contrast, turned not only to the philosophical tradition of voluntarism (Schopenhauer, Nietzsche) but also to the earliest writings of Marx and to Lenin’s correspondence so as to find the stimuli for his project of a materialistically understood ethical position.
The defence of ethical universalism can be grounded in assertion that discussion, if it is to be meaningful, assumes the validity of some minimal agreement in principles. If, however, it is a fundamental fact that the participators in the discussion of ethical questions are (at least potentially) all people, then the principles of that discussion will have universal validity. Hume’s Law, which in this study is examined in detail and precisely formulated, does not allow us to seek a generally valid basis for ethical discussion exclusively in the domain of factual assumptions. This means that the universal validity of some basic evaluative ethical principles must be recognised.
The concept of dissent as it is articulated in the work of Ladislav Hejdánek is investigated in the article. The author first utilizes Pithart’s schematic division of dissent into the protesting and the reflective in order to subsequently, in Hejdánek’s conception, distinguish yet a third, creative type of dissent. This the author then analyzes in more detail in a systematic interpretation of Hejdánek’s attitudes and thoughts (including comparisons with the texts of other dissidents and thinkers). Nevertheless, he primarily focuses on the Chartist discussion on courage, in which he clarifies Hejdánek’s position, along with a search for a possible shielding, or more precisely in the context of a civilly disobedient position of an admissible and convincing concept of morality., V předloženém textu je zkoumáno pojetí disentu v díle Ladislava Hejdánka. Autor si nejprve pomáhá Pithartovým schematickým dělením disentu na protestující a reflektující, aby následně v Hejdánkově koncepci odlišil ještě třetí, tvůrčí typ disentu. Ten následně detailněji analyzuje v systematické interpretaci Hejdánkových postojů a myšlení (včetně komparace s texty dalších disidentů a myslitelů). The concept of personal identity has recently come to play an increasingly important role in bioethical discussion concerning the beginning and end of human life. This study does not aim to represent the whole range of applications of theories of personal identity to bioethics. It focuses only on the beginning of human life, namely on the question of the moral acceptability of abortion. The author begins by describing an argument rejecting the acceptability of abortions which has been advanced by P. Lee, and it is shown that the validity of this argument depends on a certain conception of personal identity. Then the author briefly defines the psychological approach to personal identity, and he points to its weaknesses. There follows a discussion of the theory of animalism which claims that our persistence in time does not comprise any psychological factors. The conclusion of the article deals with various theories of moral status and indicates the inadequacy of functional criteria in accounting for the moral point of view. The article finishes by stating that the moral status of human beings should be founded on the concept of human dignity. The principle of double effect plays an important role in deontological ethics which give an emphasis to intentions in the process of moral evaluation of human acts. According to this principle, it is morally permissible to actualize an action with two consequences, one of which is good and the second bad, if and only if some conditions are met: for example, the bad consequence is not a means for attaining the good consequence and the bad consequence is not brought about intentionally, but only foreseen as necessarily and inevitably connected with the actualization of the action itself and its good consequence. The aim of this article is to lay necessary theoretical foundations for a better understanding and employment of the principle of double effect by discussing Hart’s critique of it and Philippa Foot’s different approach to the moral dilemmas to the solution of which the principle of double effects seems to be well applicable. In the course of my argumentation I distinguish between two types of intentions – characterizing and final intentions – and show how this distinction solve some of the difficulties connected with the understanding and application of the principle of double effect. and Princip dvojího účinku hraje důležitou roli v deontologických etikách, které přikládají důležitost intencím v procesu morálního hodnocení lidského jednání. Podle tohoto principu je morálně přijatelné aktualizovat jednání se dvěma důsledky, z nichž první je dobrý a druhý špatný, pouze za předpokladu, že jsou splněny určité podmínky: špatný důsledek například nesmí být prostředkem k dosažení dobrého důsledku a špatný důsledek nesmí být způsobený úmyslně, je pouze předvídaný jako nutně a nevyhnutelně spojený s provedením jednání samotného a s jeho dobrým důsledkem. Cílem tohoto článku je vystavět nezbytné teoretické předpoklady potřebné k lepšímu pochopení a aplikaci principu dvojího účinku. Diskutuji kritiku tohoto principu britským teoretikem práva Hartem a odlišný přístup k řešení morálních dilemat, k jejichž řešení se princip dvojího účinku zdá vhodným, v díle Philippy Footové. V průběhu své argumentace rozlišuji mezi dvěma typy intencí – charakterizující intence a finální intence – a ukazuji, jak tento rozdíl pomáhá řešit některé obtíže spojení s chápáním a aplikací principu dvojího účinku.
The author defends the idea of the ontological founding of environmental ethics. He recognises the need for a new morality that can foreshadow the biophile transformation of culture, but at the same time he knows that this morality may actually develop during the course of the transformation itself. He presents the view that the relation of man to nature is mediated not only by the relevant culture, but also by its hidden spiritual grounding, which determines the character of culture, both spiritual and material. Today’s culture finds itself in crisis because its predatory spiritual grounding is leading it to its own ruin. A biophile change in this grounding is therefore the condition for the emergence of a more sustained biophile culture. However, even if we recognise the ontological grounding of ethics, this does not necessarily mean that we fully understand the superior subjectivity of nature, nor that we recognise the higher moral principle in the relation of culture to the Earth.
